Failure of the Contractor to adhere to the Schedule shall be a material breach of this Contract and grounds for its immediate termination. The Village reserves the right to construct any improvement or to permit any construction in any street, which may have the effect, for a time, of preventing the Contractor from traveling its accustomed route or routes for collection. The Contractor shall continue to collect the Acceptable Waste, Recyclables, and Yard Waste by a reasonably acceptable method to the same extent as though no interference existed upon the streets formerly traversed, without extra cost to Village residents. Notwithstanding anything to the contrary in this Agreement, any failure or delay in performance due to contingencies beyond a party’s reasonable control, including strikes, riots, terrorist acts, compliance with applicable laws or governmental orders, fires, and acts of God (“Force Majeure”), shall not constitute a breach of this Agreement.

ADHERENCE TO SCHEDULE. Franchisee shall ensure Franchise attendance at all games scheduled by Franchisor for the Franchise during the Season. Franchisee acknowledges that such games may be played at Franchisee's facilities, at facilities secured by another franchise, or at facilities selected by Franchisor. Franchisee shall pay all expenses associated with the Franchise's travel to and attendance at such games. Franchisee shall comply with all USISL policies regarding cancellation, rescheduling of games and compensation to teams affected by cancellation or no-shows. Franchisor may require teams in any League to attend post-Season playoff games. The Franchisee or its designee shall attend a League meeting each November to finalize the game schedule. Franchisor's representatives shall coordinate and attend the League meetings.
ADHERENCE TO SCHEDULE. Subcontractor, at all times during the progress of the Work, employ enough skilled workmen, and have on hand and maintain an adequate supply of materials and equipment to complete the Work in accordance with the Schedule established by Contractor. Subcontractor agrees to keep itself continuously informed of the progress of the Project, to cooperate fully in every way with Contractor and others performing work on the Project, to coordinate its Work sequence with the work of Contractor and Contractor's other subcontractors and sub-subcontractors, to conform to all usages in the building trades, and to do nothing to hamper the performance of others. Subcontractor is aware that Contractor must conform to a strict schedule and its failure to do so will cause it to incur certain costs and expenses. In the event the Subcontractor falls behind the schedule for its Work established by Contractor to such an extent that the Contractor in good faith determines that the Subcontractor will be unable to achieve completion of its Work in accordance with the Schedule, the Contractor may direct the Subcontractor to accelerate the progress of its Work, at the Subcontractor's sole cost, which acceleration costs shall not cause an adjustment to the Subcontract Price.

At any xxxx Xxxxxx believes that its deliveries will not be made as scheduled, Seller shall give prompt written notice to Purchaser of the length of and reason for such anticipated delay. Within ten (10) days from receipt of such notice, Purchaser may, without any liability to Seller and without prejudice to any other rights or remedies, cancel all or any portion of the undelivered Purchase Order, unless the delay is caused by Purchaser.
