Additional Microsoft Indemnification Obligation. Subject to Section 22.4, Microsoft further agrees to indemnify, defend, and hold EA harmless from any and all claims, demands, costs, liabilities, losses, expenses and damages (including reasonable attorneys' fees, costs, and expert witnesses' fees) arising out of related to any Claim that EA’s use in any Sales Territory of a Licensed Trademark as permitted under this Agreement infringes the trademark rights of any third party. Microsoft shall control all litigation relating to Licensed Trademarks.
