Additional Documents and Actions. Each Subordinated Creditor at any time, and from time to time, after the execution and delivery of this Agreement, upon the request of Agent and at the expense of Borrower, will promptly execute and deliver such further documents and do such further acts and things as Agent may request in order to effect fully the purposes of this Agreement.

The General Partner is expressly authorized on behalf of the Partnership to (i) establish book entries reflecting the General Partner’s ownership of the same number of Series H Preferred Units as there are outstanding Series H Preferred Shares, (ii) execute and deliver all such other instruments, assignments, affidavits, notices, agreements, consents, certificates and other documents, and (iii) take all such further and other actions as the General Partner shall deem necessary, advisable or appropriate to carry out the transactions contemplated in this Amendment No. 2.
