Actual Delivery Date. The actual delivery date shall mean the date on which the BUILDER shall have actually delivered the VESSEL to the BUYER. However, the date on which the BUILDER shall have duly tendered the VESSEL for delivery in case of the BUYER's default as provided in Paragraph 1 (c) of Article XIII, shall be substituted for the actual delivery date, if applicable.

Actual Delivery Date. The actual delivery date of the Professional Services, is the day (whichever occurs first) when:(i) the Professional Services are accepted by Customer; or (ii) five (5) days after FCS has informed Customer that the Professional Services have been performed in accordance with the agreed description in the Statement of Work, or (iii) Customer takes the Professional Services, or a part thereof, into operational or commercial use.
