Action to Terminate. Termination of this Agreement pursuant to Section 5.1 must be accomplished by written notification by the Developer to the City within sixty (60) days after the date when such option to terminate may first be exercised. A failure by the Developer to terminate this Agreement within such period constitutes a waiver by the Developer of its rights to terminate this Agreement due to such occurrence or event.

Action to Terminate. Termination of this Agreement pursuant to Section 5.1 must be accomplished by written notification by the Developer to the EDA within sixty (60) days after the date when such option to terminate may first be exercised. Action to Terminate. If a Party wishes to terminate this Agreement written notice of termination, stating the reasons for termination under sections 10.1 or 10.2, as applicable, must be given by the terminating party to the non-terminating party within sixty (60) days after such event or condition occurs which gives the right to terminate; otherwise, such termination rights are waived with respect to such events, and such events only. Termination is effective on the effective date of such properly given notice.
