ACHD. Contractor shall be responsible for coordinating with the City to obtain appropriate ACHD permit(s) and will reimburse the City for fees, fines, or penalties City incurs due to Contractor's violation of any ACHD policy. City shall certify to ACHD that Contractor is authorized to obtain a Temporary Highway and Right-of-Way Use Permit from ACHD on City’s behalf. The parties acknowledge and agree that the scope of the agency granted by such certification is limited to, and conterminous with, the term and scope of this Agreement.

ACHD shall have the right and authority to work directly with the Contractor to resolve any claims relating in any way to the District Roadways Improvements and, any such claims will be reviewed, approved or denied by District including enforcement of the two (2) year warranty period to be begin on the date of the final acceptance letter from the District.
