ACCOUNT PAYABLE. The Borrower will, and will cause each Guarantor to, pay all of its accounts payable within 120 days, except for any accounts payable being disputed in good faith and for which, if requested by the Bank, adequate reserves have been made.
ACCOUNT PAYABLE. On the Closing Date, Purchaser will pay one hundred thousand dollars ($100,000) to Vitaquest International, Inc. as partial payment of the Company's then current accounts payable indebtedness owing to Vitaquest International, Inc. (the "Vitaquest Payable"), any remaining then outstanding accounts payable indebtedness owing from the Company to Vitaquest International, Inc. shall thereafter be paid according to the terms of the Manufacturing Agreement.
ACCOUNT PAYABLE. All payments under this Agreement shall be paid by the Company out of its general assets. The Director’s rights to receive payments under this Agreement shall be no greater than that of an unsecured general creditor of the Company.

  • Amount Payable The Subscriber will provide the funds required to purchase the Purchased Units (the “Purchase Price”) by no later than 10:00 a.m. on each Closing Date (as defined below) by certified cheque payable to the Partnership to be held in trust by the General Partner, and released in order to be applied to the purchase hereof. The Subscriber hereby instructs the General Partner to deal with the Purchase Price on the terms set forth herein.

  • Maximum Amount Payable The maximum amount payable under this contract without modification is shown in Attachment E, Fee Schedule.   • Crediting Payments The receipt of any payment item by Agent shall not be required to be considered a payment on account unless such payment item is a wire transfer of immediately available federal funds made to Agent’s Account or unless and until such payment item is honored when presented for payment. Should any payment item not be honored when presented for payment, then Borrowers shall be deemed not to have made such payment and interest shall be calculated accordingly. Anything to the contrary contained herein notwithstanding, any payment item shall be deemed received by Agent only if it is received into Agent’s Account on a Business Day on or before 1:30 p.m. If any payment item is received into Agent’s Account on a non-Business Day or after 1:30 p.m. on a Business Day (unless Agent, in its sole discretion, elects to credit it on the date received), it shall be deemed to have been received by Agent as of the opening of business on the immediately following Business Day.

  • Payment of Settlement Amount (1) Within thirty (30) days of the Date of Execution, the Settling Defendants shall pay the Settlement Amount to Siskinds LLP, for deposit into the Trust Account.

  • Accounts Receivable and Payable The accounts receivable reflected on the Financial Statements arose in the ordinary course of business and, except as reserved against on the Financial Statements, are collectible in the ordinary course of business and consistent with past practices, free of any claims, rights or defenses of any account debtor. Except as set forth on Schedule 5(g), no accounts payable of the Company are, at this date, over 45 days old and no accounts payable of the Company will be over 45 days old at the Closing Date.

  • Interest Bearing Account If the Province provides Funds before the Recipient’s immediate need for the Funds, the Recipient will place the Funds in an interest bearing account in the name of the Recipient at a Canadian financial institution.

  • Fees Payable All fees and charges (other than interest charges) that are, or may become payable in connection with the Loan are set out in the Specific Terms.

  • Capitalized Interest Account On the Closing Date, the Issuer shall deposit the Capitalized Interest Account Initial Deposit into the Capitalized Interest Account.
