Access Road. A. Construction Manager shall provide and maintain an access road capable of sustaining heavy vehicular traffic. Construction Manager shall ensure that access to the Work and the work of other contractors is provided continuously during the Contract Time.

Access Road. The access road to the demised unit delineated on the plan and thereon colored red will at all times hereafter shall be maintained jointly by all the units holders or Sub Lessees in good order and condition to the satisfaction of the Estate Manager, SEEPZ-SEZ Authority.
Access Road. (a) The Company shall within three (3) months of the Possession Date construct at its own cost and in accordance with the Access Road Specifications, an access road (the “Access Road”) on the Access Road Corridor starting from the nearest public road up to the Demised Premises. Upon completion of the Access Road, the Company shall hand over the completed Access Road to BPDB and risk and responsibility for the Access Road shall pass to BPDB from the time of the hand over.

Grantee as a condition precedent to Xxxxxxx’s right to enter upon the Road Easement Area for construction purposes must submit to Authority, plans for the initial construction of the Access Road; thereafter Grantee must submit to Authority plans for any future modifications and improvements to the Access Road constructed within the boundaries of the Road Easement Area. The Initial construction plans and plans for future modifications and improvements to the Access Road must be approved in writing by the Director of Engineering Services of Authority prior to the commencement of construction of the same, which approval shall not be unreasonably denied, delayed or conditioned. To facilitate the Authority’s review, two (2) sets of formal plans that clearly define the project must be submitted to Authority for its prior approval. The drawings must be prepared on a standard engineering format and show all physical features and improvements proposed to be installed within the boundaries of the Road Easement Area and must be signed and sealed by a Professional Engineer registered in the State of Texas. Any approval, comments or denial, of such revised initial construction plans or plans for future modifications and improvements, by the Authority shall be promptly made to Grantee within thirty (30) Business Days after Authority’s receipt of the of such revised plans or plans. Further, Authority shall prepare detailed comments or responses to the revised initial construction or plans modifications and improvements to the Access Road in order to direct Grantee on the action needed to have such plans revised and approved. The final plans for Access Road as ultimately approved by the Authority are referred to herein as the “Approved Plans”. Prior to the commencement of construction of the Access Road, Grantee will furnish Authority issued- for-construction drawings for the Access Road, if different than the Approved Plans. Access Road. County agrees that PCDC shall have the right, at its cost and expense, to make any improvements, modifications, enhancements or other changes to the access road to the Materials Repository, which access road area is shown on Exhibit “B-1” and the improvements, modifications, enhancements and other changes thereto, as presently contemplated (but which may be further modified as necessary for the operation of the Materials Repository) that are shown on Exhibit B-2 attached hereto (the “Access Road”), subject to (i) the prior written approval by County, which approval shall not be unreasonably withheld, and (ii) PCDC’s compliance with all applicable ordinances, rules and regulations of the County. PCDC shall have the right and responsibility, to undertake any road maintenance or repairs necessary so that all vehicles that use the Access Road will be able to do so on a road which is unobstructed and graded to ensure that driving on the Access Road will not damage those vehicles. The cost of maintenance or repairs performed on the Access Road by PCDC shall be borne by PCDC and shall not be deducted from the Host Fee payable hereunder. At no point shall PCDC improve, modify, enhance, or make any other change to the Access Road that would raise the elevation of the Access Road higher than the elevation of the Access Road on the Effective Date of this Agreement. PCDC shall notify County in writing following any maintenance or repairs on the Access Road performed by PCDC. PCDC shall require any contractor or subcontractor used for the performance of work or excavation work on the Access Road to be properly licensed pursuant to the laws of the state of Missouri and each contractor shall have the same obligations with respect to its work as if the work were performed by PCDC. It is understood that PCDC’s obligation to perform maintenance and repairs on the Access Road, is not abandonment of the Access Road by the County.
Access Road. (a) The access road will be constructed by NCC as per attached layout plan to connect the Demised Premises with the nearest public road and allow using it by the Company. In addition to that The Company shall take additional works related to expansion and strengthening of the access road if required at its own cost and responsibility..
