Absent Employees. (a) Where an employee is off work due to an illness, injury or vacation, his name may be posted "in absentia" providing the employee is capable of filling the job in a reasonable time.

The Purchasers or one of their Affiliates shall offer employment to any Excluded Employee on the terms and conditions required by this Agreement as if he or she were not an Absent Employee, subject to the following conditions: (i) if such Excluded Employee is on medical or disability leave, the Excluded Employee is released by his or her physician to return to active employment and (ii) such Excluded Employee actually reports for active employment with any of the Purchasers and their Affiliates (including the Transferred Subsidiaries) immediately upon such medical release or expiration of the applicable approved leave; provided, however, that the Purchasers shall not be required to offer employment under this provision after the reemployment period provided in the applicable policies of the Seller or after the expiration of any applicable domestic or foreign federal or state law period, if later. The date on which an Excluded Employee is required to become an employee of the Purchasers or one of their Affiliates is hereinafter referred to as his or her "Hire Date." The Closing Date shall be the "Hire Date" for all other Transferred Employees.
Absent Employees. An employee on sick leave of absence, or other approved leave of absence, or absent for any other excused reason or transferred to work out of the bargaining unit for a period of thirty calendar days or more, shall not be credited for any overtime during this period, but will the group with the average number of hours of such group. If no casual overtime is worked during the employee’s absence, the employee will the group with the same charged hours as the employee had credited prior to the start of the leave of absence. An employee on sick leave of absence, or other approved leave of absence, or absent for any other excused reason for a period of less than thirty calendar days shall have hours credited in accordance with Paragraph An employee transferred to work out of the bargaining unit for a period of less than thirty calendar days shall have hours credited equal to hours which the employee worked in the plant while transferred out of the bargaining unit. An employee absent from work by reason of absence due to compensable occupational injury or disease for a period of less than thirty calendar days shall not be credited for any overtime during this period. In the event such an employee is absent for a period of thirty calendar days or more, the employee shall be credited with the average number of hours charged to the group during such absence. Employees called at home for notification to come to work that same day but who cannot report for work, shall not be credited for such hours. Employees called at home for notification of work on the following day or days will be credited for such hours in accordance with Paragraph and its sub-paragraphs. and Committeepersons During the period of time an employee is serving as Chairperson, or Zone Committeeperson, overtime hours worked or offered will not be credited, nor shown on the of hours records.
Absent Employees. Notwithstanding anything else in this Article 8, in respect of any Employee who is absent from work immediately prior to and on the Closing Date on an approved leave of absence, including pregnancy, parental, jury, medical or disability leave, Buyer shall offer employment to such Employee in accordance with the terms of this Article 8, except that for any Employee who is absent from work on such a leave of absence the date of termination of employment with Seller and the date of commencement of employment with Buyer shall be the day after the expiry of the leave.

Absent Employees. When any Absent Employee is physically and/or mentally able to return to work and, if applicable, has received a doctor’s clearance to return to work, at that time such Absent Employee shall be deemed a Company Employee for purposes of this Section 10.2 and Seller or LOL shall terminate such Absent Employee and Buyer shall immediately offer employment to such Absent Employee under the same conditions as provided above; provided, however, that any Absent Employee who has not returned to work within one (1) year of the Effective Time shall cease to be an Absent Employee eligible to become a Buyer’s Employee unless otherwise agreed by Buyer. Buyer shall hire such Absent Employee if he or she accepts Buyer’s offer of employment and reports to work for Buyer on a timely basis in which event such employee (as of the date of such hire, the “Return to Work Time”) shall be deemed a “Buyer’s Employee” for purposes of this Agreement. Buyer shall comply with all applicable Laws regarding non-discrimination in making its decisions about making offers of employment to Absent Employees and the employees listed on Schedule 10.1, including, without limitation, requirements for reasonable accommodation of employees on disability leave.
