A10. 1 The Contractor shall effect and maintain with an insurance company or companies acceptable to DCLG a policy or policies of insurance to provide a level of cover sufficient for all the matters which are the subject of the indemnities and undertakings on the part of the Contractor contained in the Contract and in accordance with any legal requirements for the time being in force.
A10. 5. The Contractor shall be liable for all loss of, or damage to, the Property (excluding fair wear and tear), unless such loss or damage was caused by the Authority’s Default. The Contractor shall inform the Authority within two (2) Working Days of becoming aware of any defects appearing in, or losses or damage occurring to, the Property.
A10. 2 If we overpay you for providing the Services, as soon as you become aware of such overpayment you agree to immediately notify us in writing of that overpayment. You agree to repay any overpayment to our Payment Agent within ten Working Days of:

A10. No employee shall be required to deliver any documents to the Company’s Operations Office unless they are paid for time and mileage to do so. A11 The Company shall make every effort to update the post orders annually. In the event of a discrepancy between the post orders and the actual work performed on a site the Union can request a Labour / Management meeting be convened to resolve the discrepancies. A12 If the Company requires a driver’s abstract from any employee they shall pay any and all fees associated with obtaining such abstract. A13 Where an employee is charged criminally or where any cause of action is brought against any employee in relation to their employment, through no fault of the employee, the Company shall pay for the employee’s legal representation. A14 No Employee shall be required perform any work normally performed by a person who is lawfully on strike. A15 Any and all discipline shall be removed twelve (12) months from the date of issue. A16 The Company will create a pass-on book for each permanent site where possible, in order to allow guards to pass on important information to future guards and consecutive shifts. It will be the responsibility of the guards to keep pass-on books updated. A10. Unless a State chooses to reach bilateral agreement with the Commonwealth under clauses A18 to A22 on this matter, the scope of public hospital services funded on an activity or block grant basis that are eligible for a Commonwealth funding contribution will include:

A10. 2.5 The FWC (or arbitrator) should, where relevant, consider the principles set out in subclause A10.2.4 above in conducting any conciliation, arbitration or making any determination.
A10. 2.7 Any agreement reached under subclause A10.2.1 or determination made under subclause A10.2.6 must ensure there is no disadvantage to employees, diminution or reduction to employees’ remuneration, terms and conditions of employment, roles, position or classification descriptions (of those employees covered by this agreement) in terms of remuneration and terms and conditions of employment.
A10. 2.8 Any increases to allowances in items A10.1.1 and A10.1.2 shall apply from the date of commencement of this Agreement. WORKING IN ACTF&R
