Project Improvements definition

Project Improvements means site improvements and facilities that are:
Project Improvements means site improvements and facilities that are planned and designed to provide service for a particular development project and that are necessary for the use and convenience of the occupants or users of the project, and are not system improvements. No improvement or facility included in the city’s transportation facilities plan or transportation improvement plan approved by the city council shall be considered a project improvement.
Project Improvements means all of the improvements including all buildings, structures, improvements and fixtures located on or to be purchased, constructed and otherwise improved on the Project Site pursuant to Article III hereof, and all additions, alterations, modifications and improvements thereof made pursuant to this Agreement.

  • The GL Policy for Project Improvements Work of Owner’s other contractors and subcontractors shall be in such amount and such policy limits as meets the Insurance Standard for such contractors and subcontractors.

  • No Approvals or confirmations by the City Parties or City Representative under this Agreement shall relieve or release Owner from any Applicable Law relating to the design, construction, development, operation or occupancy of the Project Improvements (including Applicable Law that are procedural, as well as or rather than, substantive in nature).

  • Owner shall design, develop and construct, or have designed, developed and constructed, the Project Improvements within the Complex Site in accordance with the terms and conditions of this Agreement and all Applicable Law, and shall adhere to the Project Construction Schedule (subject to any Excusable Owner Delay and/or City Party Delay permitted in accordance with the terms of this Agreement), in each case, at Owner’s sole cost, risk and expense.

  • Owner shall also procure, or cause to be procured, at Owner’s sole cost and expense, any and all necessary permits, licenses, registrations, or other authorizations required for the lawful and proper installation and maintenance upon the Complex Site of wires, cables, pipes, conduits, tubes, fiber optics and other equipment and appliances for use in supplying any such service to the Project Improvements and upon the Complex Site.

  • Owner shall not, without the prior Approval of City, initiate, join in or consent to any variance, private restrictive covenant or other public or private restriction as to the use of the Project Improvements or any portion thereof, or any declaration, plat or other document having the effect of subjecting the Project Improvements to the condominium or cooperative form of ownership.


More Definitions of Project Improvements

Project Improvements means the buildings, structures, improvements and fixtures to be purchased, constructed, installed and otherwise improved or located on the Project Site pursuant to Article IV of the Lease and paid for in whole or in part from the proceeds of Bonds, as described in Exhibit B attached hereto, and all additions, alterations, modifications and improvements thereof made pursuant to the Lease.
Project Improvements means site improvements and facilities that are planned and designed to provide service for a particular development project and that are necessary for the use and convenience of the occupants or users of the project and are not system improvements. The character of the improvement shall control a determination of whether an improvement is a project improvement or system improvement and the physical location of the improvement on site or off site shall not be considered determinative of whether an improvement is a project improvement or a system improvement. If an improvement or facility provides or will provide more than incidental service or facilities capacity to persons other than users or occupants of a particular project, the improvement or facility is a system improvement and shall not be considered a project improvement. No improvement or facility included in a plan for public facilities approved by the governing body of the municipality or county shall be considered a project improvement.
