Taking compassionate leave. An employee is entitled to take the compassionate leave in a single unbroken period, in separate periods of one (1) day each or any separate periods agreed between the employee and the employer. Where the employee is taking compassionate leave to spend time with a member of the employee’s immediate family or household who has contracted or developed a personal illness or sustained a personal injury as outlined in this clause, the employee is entitled to start to take the compassionate leave at any time while the illness or injury persists.

Council may request the provision of evidence which would satisfy a reasonable person that the absence is permissible under this clause, such as a medical certificate, statutory declaration, death certificate or death notice from a local newspaper.

An Employee may take compassionate leave for a particular permissible occasion as: a single continuous period of up to 3 or 5 days as detailed above or any separate periods to which the Employee and VFST agree. If the permissible occasion is the contraction or development of a personal illness, or the sustaining of a personal injury, the Employee may take the compassionate leave for that occasion at any time while the illness or injury persists. Payment for compassionate leave (other than for casual Employees) If, in accordance with this clause, an Employee, other than a casual Employee, takes a period of compassionate leave, VFST must pay the Employee at the Employee’s base rate of pay for the Employee’s ordinary hours of work in the period. Note: For casual Employees, compassionate leave is unpaid leave. Evidence Proof of such death shall be furnished by the Employee to the satisfaction of VFST. Provided that this clause shall have no operation while the period of entitlement to leave under it coincides with any other period of entitlement to leave (other than annual leave). EXCEPTIONAL CIRCUMSTANCES LEAVE VFST RECOGNISES THAT EXCEPTIONAL AND/OR EXTREME CIRCUMSTANCES MAY ARISE IN AN EMPLOYEE'S PERSONAL LIFE THAT ARE OF SUCH MAGNITUDE AS TO CAUSE SIGNIFICANT DISRUPTION TO THE EMPLOYEE'S ATTENDANCE AND/OR PERFORMANCE AT WORK. EXCEPTIONAL CIRCUMSTANCES LEAVE IS AVAILABLE TO ASSIST EMPLOYEES MANAGE THESE CIRCUMSTANCES ON COMPASSIONATE GROUNDS. ENTITLEMENT UP TO TEN (10) DAYS PER CALENDAR YEAR, NON-CUMULATIVE, AS PAID LEAVE TO BE USED FOR NECESSARY ABSENCES FROM THE WORKPLACE. THIS LEAVE WILL BE IN ADDITION TO EXISTING LEAVE ENTITLEMENTS AND MAY BE TAKEN AS CONSECUTIVE OR SINGLE DAYS, OR AS A FRACTION OF A DAY. Additional paid or unpaid leave may be sought by approval, to be assessed on a case by-case basis.
