Outside the Bargaining Unit. Prior to an employee performing duties outside the bargaining unit, the employer, the union and the employee shall meet to determine the terms of the assignment. The employee has the right, at any time, to refuse to perform higher- level duties.

Outside the Bargaining Unit. Employees shall not be transferred to positions outside the bargaining unit without their consent. Employees shall not continue to perform bargaining unit work while transferred outside the bargaining unit. The seniority of employees transferred outside the bargaining unit shall be retained but shall not accumulate during the period of such transfer provided the employees are not outside the bargaining unit an accumulated period of more than six (6) months in any twelve (12) consecutive calendar months. The University will inform the Union of any transfers. Employees who return to the bargaining unit within the periods provided by this provision shall be placed in a job consistent with their seniority and classification at the time they were transferred. Employees who do not return within such periods shall lose their seniority and cease to have any rights pursuant to the Collective Agreement.
Outside the Bargaining Unit. (a) Where a member of the bargaining unit successfully applies for a temporary vacant position or a position outside the Bargaining Unit, the Board shall notify the Union of the employee’s name and the date that the employee will commence duties in the new position. Such position shall be for a maximum of eighteen (18) months. The term of such position may be extended by mutual agreement of the Parties. A Member of the Bargaining Unit who accepts a temporary position shall have the right of return to former position within the Bargaining Unit, if it still exists. If it does not, the Member will be subject to Article and Recall. Such Member shall continue to accumulate seniority during such period. While in such position, the Member will be required to continue to pay Union dues during the term of the position. Where a Member of the Bargaining Unit accepts a permanent position outside the Bargaining Unit, shall not have a right of return to a Bargaining Unit position unless the Member is successful in applying for a position in the Bargaining Unit.
Outside the Bargaining Unit. When an Employer temporarily assigns an employee to carry out the assigned responsibilities of a higher paying classifica- tion outside the bargaining unit for a period in excess of one half of one shift, the employee shall receive an allowance of three dollars for each shift from the time of the assignment.
Outside the Bargaining Unit. When a vacancy occurs in a position not covered by this Agreement, properly qualified employees shall have the opportunity of applying for the position before such vacancy is filled by other means. Employ- ees so transferred upgraded to a regular staff position may remain a member of the Union for a period of days. When disabled employees return to work after an extended period of absence and all moves to replace them have been made regular, they are to be placed on their former job providing they are still properly qualified and in the opinion of the Commission’s Medical Consultant physically capable of performing the duties involved. In such cases the most junior employee on the job classification involved is to be downgraded. The downgraded employee will have first consid- eration for future vacancies in the classification from which displaced. CODE OF PRACTICE This Code of Practice is subject to change from time to time when mutually agreed upon without affecting the Agreement. Yard inspection shall be done during the daylight hours. No changes will be made to the supervision and use of Overhead Line Crews without consultation with the Union. In the absence of a foreperson, the Senior Overhead Lineperson of that crew shall take charge. Employees if detailed to do ajob which they feel they are incapable of performing properly through lack of experience or training, shall so inform their superior when detailed for the work. All substation maintenance, subway signal maintenance and con- struction work must be done by not less than two employees, with the senior of the two being an employee of a grade in keeping with the complexity of the job. Outside the Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without their consent. An employee transferred out of the unit shall retain their seniority for up to sixty (60) shifts. If the employee returns to the bargaining unit within the sixty (60) shifts, they shall move back into the position they held prior to leaving the unit. Other employees affected shall also bump back into their original positions.
