Modification Date definition

Modification Date has the meaning specified in Section 2.18(a).

Modification Date means 8 August 2018 when the Index was modified to include financial companies under CROCI Coverage, to remove secondary share classes, and to use CROCI Market Capitalisation instead of Free-Float Market Capitalisation for the calculation of CROCI Economic Equity Earnings. The Index has been in the form as set out herein since the Modification Date.

• Following the Modification Date, this Settlement Agreement shall be deemed to have been jointly drafted by the Parties, and in construing and interpreting this Settlement Agreement, no provision shall be construed and interpreted for or against any of the Parties because such provision or any other provision of the Settlement Agreement as a whole is purportedly prepared or requested by such Party.

Modification Date shall have the meaning assigned to such term in Section 2.23.

Modification Date means the date on which a Letter of Credit is amended, renewed or extended in accordance with the terms of Section 2.04.

Modification Date means the date on which occurs the execution and delivery by all parties of (i) this Agreement, (ii) the amendment and restatement of the Anchor Investment Agreement, (iii) the amendment and restatement of the Minority Investors Agreement, (iv) the CapGen Investment Agreement, and (v) such other modifications of the other Transaction Agreements as is mutually agreed by the Anchor Investors, the Company and CapGen.

By providing electronically signing this Deposit Agreement and continuing to maintain an Account with us, you agree to the most recent version of the Deposit Agreement, which we make available through Online Banking. Additionally, we will apply Rewards Program changes prospectively, meaning that the change will not affect any Monthly Savings Rewards you have already received.

Modification Date means the earliest to occur of (a) the last day of the fiscal quarter during which the Start of Production Date occurs, (b) the last day of any fiscal quarter during which Capital Expenditures of the U.S. Project Finance Group during such fiscal quarter exceed the amount budgeted therefor in any Construction Budget then in effect by more than 110% and (c) June 1, 2026; it being understood and agreed that the Issuer will notify the Noteholder in writing of the occurrence of the Modification Date (for the avoidance of doubt, failure to deliver notice shall not invalidate the occurrence of the Modification Date).
