Exchangeable Securities definition

Exchangeable Securities means any securities of any trust, limited partnership or corporation other than the Trust that are convertible or exchangeable directly for Units without the payment of additional consideration therefore;
Exchangeable Securities means the exchangeable securities issued by CanCorp Europe, in the form of interest bearing notes, non-interest bearing notes and common shares;
Exchangeable Securities has the meaning set forth in Section 6 of this Agreement.

  • None of the Company, the Partnership nor the Fund shall propose, agree to or otherwise give effect to any amendment to, waiver of or forgiveness of its rights or obligations under this Agreement without the approval of the holders of the Exchangeable Securities, other than such amendments, waivers and/or forgiveness as may be made pursuant to Section 6.6.

  • ECT hereby represents, warrants and covenants in favour of the holders of Exchangeable Securities, EIFH and the Fund that ECT has reserved for issuance and will, at all times while this Agreement is outstanding, keep available, free from any pre-emptive and other rights granted by ECT, such number of ECT Common Units, ECT Preferred Units or ECT Class B Units, as applicable, as are issuable under the applicable Exchange Right.

Exchangeable Securities means any securities of any trust, limited partnership or corporation other than the Trust that are convertible or exchangeable directly for Trust Units without the payment of additional consideration therefor and, for greater certainty, includes the Class B LP Units;
