Enforcing Party definition

Enforcing Party. In connection with any Repurchase Request, (i) in the event one or more Requesting Certificateholders or Consultation Requesting Certificateholders has delivered a Final Dispute Resolution Election Notice with respect thereto pursuant to Section 2.03(g) of this Agreement, with respect to the mediation or arbitration that arises out of such Final Dispute Resolution Election Notice, such Requesting Certificateholder(s) and/or Consultation Requesting Certificateholder(s), or (ii) in all other cases, the Enforcing Servicer.
Enforcing Party. In connection with any Repurchase Request, (i) in the event one or more Dispute Resolution Requesting Holders has delivered a Final Dispute Resolution Election Notice with respect thereto pursuant to Section 2.03(g) of this Agreement, with respect to the mediation or arbitration that arises out of such Final Dispute Resolution Election Notice, such Dispute Resolution Requesting Holder(s), or (ii) in all other cases, the Enforcing Servicer.

Examples of Enforcing Party in a sentence

  • The Buyer, the Enforcing Party and/or the assignee or transferee shall execute such documents as are reasonably necessary to give effect to the assignment, novation, transfer or disposal referred to in clause (b) (“Appointment and rights of Enforcing Party”).

  • If the amount in relevant currency that may be so purchased for any reason falls short of the amount originally due, the LLP shall indemnify and save harmless the Applicable Enforcing Party and such Person from and against all loss or damage arising out of or as a result of such deficiency.
