Delay definition

Delay means: a delay in the Achievement of a Milestone by its Milestone Date; or a delay in the design, development, testing or implementation of a Deliverable by the relevant date set out in the Implementation Plan;
Delay means the non-performance of the Supplier with regard to Delivery in accordance with the Delivery Time, or when a substantial part of the Deliverables is not delivered in the agreed quality, and this is not due to force majeure or to circumstances for which the Buyer is responsible.

  • In addition to any extensions to the time for performance of any obligation due to a Permitted Delay, the County, in its sole discretion (acting through the County Executive Officer or designee) may extend the time for performance by Developer of any obligation hereunder.

  • If, by reason of "Unavoidable Delay" as defined in Schedule B – Tarion Addendum and Statement of Critical Dates, the Vendor is required to extend the Closing, the Vendor shall be entitled to extend the Closing provided the Vendor complies with the provisions of Schedule B - Tarion Addendum and Statement of Critical Dates in respect of such extensions.
