Examples of Delay in a sentence
In addition to any extensions to the time for performance of any obligation due to a Permitted Delay, the County, in its sole discretion (acting through the County Executive Officer or designee) may extend the time for performance by Developer of any obligation hereunder.
If, by reason of "Unavoidable Delay" as defined in Schedule B – Tarion Addendum and Statement of Critical Dates, the Vendor is required to extend the Closing, the Vendor shall be entitled to extend the Closing provided the Vendor complies with the provisions of Schedule B - Tarion Addendum and Statement of Critical Dates in respect of such extensions.
Any claim for an extension of time due to an Excusable Delay to be valid and binding must be made in writing and received by the other party not more than fifteen (15) days after the commencement of the delay; otherwise it shall be waived.
If written notice of such delay is given to County within thirty (30) days of the commencement of such delay, an extension of time for such cause shall be granted in writing for the period of the Permitted Delay, or longer as may be mutually agreed upon.
Seller, at its expense, shall use its best efforts to mitigate any adverse effects or costs to Buyer due to any actual or potential Excusable Delay, including: (a) the implementation of a production contingency plan; and (b) upon Buyer’s express written authorization, increasing Seller’s inventory of Goods and Services to a level sufficient to sustain deliveries during such Excusable Delay.
