Standards for Performance. Pursuant to 45 CFR § 303.107(b) and 45 CFR § 305.63, and upon adequate grant funding sufficient to meet staffing needs, the Parties to this POC agree to maintain an organizational structure and sufficient staff to maximize compliance with all Title IV-D performance standards, including time frames as defined in all relevant federal and state laws and regulations.

Standards for Performance. The Company shall carry out all of its activities relating to the Services in conformity with Good Industry Practice and Applicable Law. The Company shall not request Transource or a Provider to proceed with any act in connection with this Pennsylvania Services Agreement, and neither Transource nor either Provider shall have any obligation to undertake any such act, unless and until any necessary regulatory approvals for such act have been obtained.

Standards for Performance. Consultant shall at all times act in the best interests of OncoVista and will devote his best efforts, energies and skills to the provision of the Services. To this end, Consultant will devote a minimum of eight days, or 64 hours, per month, to the Services with the specific days to be mutually agreed upon by OncoVista and Consultant. OncoVista will also compensate Contractor at a rate of $125.00 per hour should OncoVista request the Consultant work additional hours in excess of 64 hours in any month.
