Possession and Enjoyment. The Lessor hereby covenants to provide the State during the term of this Agreement with the quiet use and enjoyment of the Equipment, and the State shall, during the term of this Agreement, peacefully and quietly have and hold and enjoy the Equipment, without suit, trouble or hindrance, except as expressly set forth in this Agreement.
Possession and Enjoyment. During the Term of this Agreement, the Foundation shall provide the Charter School with quiet use and enjoyment of the Facility and during such term the Charter School shall peaceably and quietly have and hold and enjoy the Facility, without suit, trouble, or hindrance from the Foundation, except as expressly set forth herein. The Foundation will, at the request of the Charter School and at the Charter School’s cost, join in any legal action in which the Charter School asserts its right to such possession and enjoyment to the extent the Foundation may lawfully do so. Notwithstanding the foregoing, the Foundation shall have the right to inspect the Facility as provided in Section 3.3 hereof.
Possession and Enjoyment. The Trustee hereby covenants to provide the Council during the Term of this Lease with quiet use and enjoyment of the Land and Facilities, and the Council shall during such Term peaceably and quietly have and hold and enjoy the Land and Facilities, without suit, trouble or hindrance from the Trustee, except as expressly set forth in this Lease. The Trustee will, at the request of the Council and at the Council’s cost, join in any legal action in which the Council asserts its right to such possession and enjoyment to the extent the Trustee may lawfully do so.
Possession and Enjoyment. As long as Lessee pays the rent as specified in this Lease and performs all of its obligations under this Lease, Lessee may peacefully and quietly hold and enjoy the Premises for the term of this Lease.
Possession and Enjoyment. The Lessor covenants that the Lessee, upon making the payments and performing the conditions and covenants prescribed herein, shall have peaceful and quiet enjoyment of the leased premises. It is agreed that by occupying the premises, that Lessee accepts the premises and acknowledges that they are in the condition called for in this lease, and that all conditions precedent to Lessee's occupying the premises have been fulfilled by Lessor.
Possession and Enjoyment. From and after the installation and acceptance by Lessee of each Equipment Group in accordance with the terms of this Lease Agreement, Lessee shall have the quiet use and enjoyment of such Equipment Group, and Lessee shall during such Lease Term peaceably and quietly have and hold and enjoy such Equipment Group, without suit, trouble or hindrance from Lessor, except as expressly set forth in this Lease Agreement. Lessor will, at the request of Lessee and at Lessee's cost (such cost to be reasonable), join in any legal action in which Lessee asserts its right to such possession and enjoyment to the extent Lessor lawfully may do so.
Possession and Enjoyment a) Lessor agrees that Lessee, paying the royalties and performing the other terms and conditions of this lease, may peaceably hold and enjoy the leased Premises during the lease term without any interruption by Lessor or any other person lawfully claiming by, through or under Lessor. Lessor shall have the right, during the term of this Agreement, to enter upon the leased Premises during normal business hours for the purpose of inspection and determination of compliance with the mining specifications and conditions, or conformance to the Mining Plan or the Landfill/Backfill Plan.
Possession and Enjoyment. Lessor hereby covenants to provide the City during the Term of this Lease with the quiet use and enjoyment of the Property, and the City shall during the Term of this Lease peaceably and quietly have and hold and enjoy the Property, without suit, trouble or hindrance from Lessor, except as expressly set forth in this Lease. Lessor will, at the request of the City and at the City's costs, join in any legal action in which the City asserts its right to such possession and enjoyment to the extent Lessor lawfully may do so.
Possession and Enjoyment. Unless otherwise specifically provided herein, from the Commencement of Construction (defined in Section 7 below) until the Lease Conversion Date, Developer shall be entitled to peacefully hold and enjoy the Unimproved Parcel without any interruption by District or any person lawfully claiming by, through or under District during the Term, except that District may enter upon and inspect the Unimproved Parcel by providing Developer with written notice of its intent to do so not less than twenty-four (24) hours in advance.
Possession and Enjoyment. The District acknowledges and agrees that Brings, by paying the Rent and performing the other terms and conditions of this Lease, may peaceably hold and enjoy the Leased Property for the private uses described above without any interruption by the District, or any person lawfully claiming by, through or under the District, during the Term except the District shall have the right to enter upon and inspect the Leased Property by providing Brings with written notice of its intent to do so not less than 24 hours prior thereto.
