Fuel Supply. Seller shall supply all fuel required for the Power Product and any testing or demonstration of the Generating Facility.
Fuel Supply. Fuel Supply After COD Commencing as of the Phase 1 Commercial Operation Date, GPA shall deliver Fuel to Project Company in compliance with the Fuel Specifications for each day of operation, at such times as it may be required by Project Company to satisfy the hourly dispatch requirements to be provided by GPA (the “Fuel Supply Requirement”). All Fuel required to be delivered by GPA to Project Company under this Article shall be delivered to the corresponding Fuel Delivery Point and shall be measured at the corresponding Fuel Measurement Point in accordance with the provisions set forth in Schedule 12. Project Company shall be responsible for the installation, operation and maintenance of the Fuel measurement facilities. Unless Project Company informs GPA otherwise, the Fuel Supply Requirement shall be consistent with the Guaranteed Heat Rate specified in Schedule 2, adjusted to Site Conditions and expressed in BTUs per kWh. In the event the expected operating heat rate applicable to any period of operation is higher than the corresponding Guaranteed Heat Rate, Project Company shall inform the magnitude of the deviation, the likely cause of such deviation, and the way this deviation is going to be corrected. Project Company shall use its best efforts to meet the Guaranteed Heat Rate. GPA shall supply the Fuel Supply Requirement even if the expected operating heat rate is higher than the Guaranteed Heat Rate. Each Party shall cooperate reasonably with the other Party to coordinate the supply and transportation of Fuel to the Fuel Delivery Point with the operation of the Plant as follows: (x) by providing the other Party such information as the first Party shall reasonably request regarding the supply and transportation of the Fuel to the Fuel Delivery Point (on both a historical and estimated future basis); and (y) by maintaining personnel available at all times to address scheduling of Fuel supply and transportation. Subject to the foregoing, GPA shall have the right to change the quantities of Fuel nominated and received on a daily basis, or more frequently, to the extent permitted, so long as such changes do not disrupt Project Company’s operations. GPA shall be deemed to be in exclusive control of, and responsible for any damage or personal injury caused by, Fuel up to the Fuel Delivery Point. Fuel Supply. Owner shall cause natural gas and fuel oil to be provided for use at the Facility, in such quantities as contemplated pursuant to the Project Agreements and as reasonably requested by Operator pursuant to Section 3.21. Owner shall be responsible for the placing of all natural gas and fuel oil contracts or agreements based on the information to be provided by Operator under this Agreement. Owner shall be responsible for making direct payment on invoices for natural gas and fuel oil to the applicable suppliers.

Fuel Supply. Owner shall arrange contractually for supply and transportation of Fuel to the Project and administer the invoicing, billing and payment for such Fuel, in a quantity and of a quality sufficient to enable Operator to perform the Services in accordance with the terms of this Agreement. Fuel Supply. Biomass fuel is trucked on-site from various locations. The fuel may consist of xxxxx’ by-products or other biomass sources. Natural gas comes directly from the neighboring TC Energy metering building. The high-pressure gas is used for the wood boiler burners while the low-pressure gas is used for domestic purposes. Waste Heat from the neighboring TC Energy compressor station is converted to steam on site in a Once Through Steam Generator. 8.0 Water and Wastewater Supply and Return (including a description of the Facility’s cooling needs and equipment washing requirements Water is supplied from the Kabinakagami river. Sewage from the plant’s washroom facilities is routed to a septic system within the site boundaries. All process wastewater from the plant is released through the approved process in our Environmental Compliance of Approval permit. All of the cooling needs for the plant are done by the water-cooled tower. 11. Fuel Supply. (1) Supplier shall deliver and sell diesel fuel to Retailer at each of Retailer’s Operated truck stop locations by delivering on a ratable (over seven day week basis as necessary on a location by location basis) basis, in bulk, the Pathway Supplied Gallons Target determined on a location by location basis. Pathway Supplied Gallons with Retailer’s fuel purchasing manager or designee, it being understood by the parties that Retailer, in limited circumstances, may not be able to take delivery of Supplier’s fuel at its locations at certain times as a result of fuel tank capacity and other limitations. All sales of fuel by Supplier to Retailer shall be made on a gross gallons basis, except as to any location where state law or regulation requires the sale to be on a net gallons basis. All deliveries of Pathway Supplied Gallons by Supplier to Retailer shall be made at Supplier’s sole cost and expense F.O.B. Retailer’s designated fuel tank at the location and by means of a reputable common carrier which meets the insurance requirements specified by Retailer from time to time for all of its carriers, and in accordance with any other reasonable requirement of Retailer applicable to all of its carriers and suppliers, which requirements will be supplied to Supplier in writing. Supplier shall use reasonable efforts to use the same common carrier that Retailer is using for each location.
