Design of the Work. The preliminary design of the Prudential Drive Extension and Parking Improvements is shown on the site plan attached hereto as Exhibit N (the “Preliminary Site Plan”). Upon the request of Elements, the parties shall coordinate the development of and agreement upon final construction plans and specifications for the Work, to be prepared at Elements’ expense and generally in accordance with the Preliminary Site Plan (the “Civil Plans”). Notwithstanding the foregoing, Elements may elect for the Prudential Drive Extension to vary from that set forth on Preliminary Site Plan, which changes may include alignment adjustments. In addition, School Board shall be entitled to approve the changes to the Prudential Drive Extension which affect access to the School Board’s land and which have an impact upon the Parking Improvements, which approval shall not be unreasonably withheld, conditioned or delayed. In the event that design changes result in changes to the parcels, the Surveys shall be revised and updated by Elements as appropriate.

Design of the Work. 4.1.1 Design %20Au Contractor shall proceed with the design of the Work, and the submission of design to Owner, in accordance with the Contract, including but not limited to the Baseline Program and the Submittal and Design Review Program. As part of Contractor’s design obligations, Contractor’s design of a Trainset shall demonstrate to the reasonable satisfaction of Owner that the requirements of the Performance Specification in relation to that Trainset have been understood by Contractor and that the implementation of Contractor's design will lead to Work which at all times meets the requirements of the Contract, including Contract requirements related to Contractor provision of Spares set out in Article 13.

  • Completion of the Work The Contractor must obtain Material Completion as defined in Section 6.1.2 below prior to any occupancy of the Project.

  • SCOPE OF THE WORK The Contractor shall furnish all the materials, perform all of the Work, and do all things required by the Contract Documents.

  • PROGRESS OF THE WORK Notwithstanding any other provision of the Contract Documents, if Contractor fails or refuses, for any reason and at any time, to furnish adequate materials, labor, equipment, tools and/or services to maintain the progress of the Work, District may, in its sole discretion, after seventy-two (72) hours’ advance written notice of same from District to Contractor, direct, instruct, and authorize a separate contractor selected by District to furnish such materials, labor, equipment, tools and/or services necessary to maintain progress of the Work. District may in its discretion deduct the amount of any and all costs, expenses, and/or other charges incurred thereby from the Contract Price then or thereafter due Contractor.

  • Cost of the Work § 6.1 For purposes of this Agreement, the Cost of the Work shall be the total cost to the Owner to construct all elements of the Project designed or specified by the Architect and shall include contractors’ general conditions costs, overhead and profit. The Cost of the Work also includes the reasonable value of labor, materials, and equipment, donated to, or otherwise furnished by, the Owner. The Cost of the Work does not include the compensation of the Architect; the costs of the land, rights-of-way, financing, or contingencies for changes in the Work; or other costs that are the responsibility of the Owner.

  • SUPERVISION OF THE WORK 6.1 Contractor shall supervise and direct the Work, using Contractor’s best skill and attention. Contractor shall be solely responsible for all methods, techniques, sequences and procedures, and shall coordinate all portions of the Work. County will deal only through Contractor, who shall be responsible for the proper execution of the entire Work.

  • Acceptance of the Work 19.1 The Contractor shall correct any Work that fails to conform to the requirements of the Contract Documents where such failure to conform appears during the progress of the Work, and shall remedy any defects due to faulty permitting, design, materials, equipment or workmanship which appear within a period of one year from the Date of Final Settlement of the Contract or within such longer period of time as may be prescribed by law or by the terms of any applicable special guarantee required by the Contract Documents. The provisions of this Article apply to Work done by Subcontractors as well as to Work done by direct employees of the Contractor, and are in addition to any other remedies or warranties provided by law.

  • Construction Development of the Project The Allottee has seen the proposed layout plan/demarcation-cum-zoning/sanctioned plans, / site plan / building plan, specifications, amenities and facilities, etc. depicted in the advertisement / brochure / agreement / website (as the case may be) regarding the Project where the Said Independent Floor for residential usage along with parking is located and has accepted the floor / site plan, Payment Plan and the specifications, amenities, facilities, etc. [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the bye-laws such as Haryana Building Code, 2017, FAR, density norms, provisions prescribed, approved plans, terms and condition of the license/ allotment as well as registration of RERA, etc. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent authorities and shall also strictly abide by the provisions and norms prescribed by the relevant State laws and shall not have an option to make any variation/ alteration/ modification in such plans, other than in the manner provided under the Act and Rules made thereunder or as per approvals/instructions/ guidelines of the competent authorities, and any breach of this term by the Promoter shall constitute a material breach of the Agreement.

  • CONSTRUCTION OF THE PROJECT The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment/ Plot and accepted the floor plan, payment plan and the specification, amenities and facilities annexed along with this Agreement which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent authorities and shall also strictly abide by the bye-laws, FAR, and density norms and provisions prescribed by the relevant building bye-laws and shall not have an option to make any variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of this Agreement.
