BY THE MUNICIPALITY. The Municipality may provide Notice to FortisBC that it requires Company Facilities to be altered, changed or relocated to accommodate its requirements. FortisBC will comply with the Municipality’s requests to the extent it is reasonably able to do so and with reasonable speed and dispatch after receipt of written request. The Municipality agrees to pay for all of the costs for changes to the affected Company Facilities. This section 8.2 is an agreement between the Municipality and FortisBC for the purpose of section 76(1)(c) of the Oil and Gas Activities Act.
BY THE MUNICIPALITY. As a material inducement to entering into this ESA, the Municipality hereby represents and warrants to Competitive Supplier as as follows: as of the date of execution of this ESA, this ESA constitutes a legal, valid and binding contract of the Municipality enforceable in accordance with its terms, subject to applicable law; as of the Effective Date of this ESA: the execution, delivery and performance of this ESA are within the Municipality's powers, have been or will be duly authorized by all necessary action; Municipality has all authorizations from local Governmental Authority necessary for it to legally perform its obligations under this ESA or will obtain such authorizations in a timely manner prior to when any performance by it requiring such authorization becomes due; and no Bankruptcy is pending or threatened against the Municipality;

FortisBC shall provide estimates and invoices to the Municipality in respect of such work in accordance with Section 15 of this Agreement. This Section 9.2 is an agreement between the Municipality and FortisBC for the purpose of section 76(1)(c) of the Oil and Gas Activities Act.

  • Government All of LESSEE's obligations under this Lease will continue to the same extent as if such requisition had not occurred.

Remuneration, including pensions, paid by, or out of funds created by, one of the States or a political subdivision or a local authority thereof to any individual in respect of services rendered to that State or subdivision or local authority thereof in the discharge of functions of a governmental nature may be taxed in that State.
