If return of a participant is delayed more than ten days beyond the scheduled return date, this benefit shall only be payable upon submission of proof that the sick or injured person was admitted and confined to hospital as an in-patient for more than 48 hours.   • Early Departure If Tenant vacates prior to the 30th day of the notice to vacate, Tenant may notify Landlord and surrender all keys. Tenant understands that he/she is still responsible for rent and utilities until the 30th day of the notice to vacate and until the end of the current Agreement term. It shall be the Landlord’s responsibility to put forth reasonable effort to prepare and re-rent the Premises.   • Disputes between the Parties Any dispute between the Parties in connection with this Agreement shall be resolved by arbitration in accordance with the procedures set forth in Exhibit B; provided, however, that either Party may seek a restraining order, temporary injunction, or other provisional relief in any court with jurisdiction over the subject matter of the dispute and sitting in Houston, Texas, if such Party in its sole judgment believes that such action is necessary to avoid irreparable injury or to preserve the status quo ante.
