Resident acknowledges and agrees that he or she will fully comply with XxXxxx Health's Policy on Business Practices (commonly known as the "XxXxxx Health Code of Conduct") and the Policy and Procedures Regarding Compliance with the Anti-Kickback Statute and the Xxxxx Law, which are also set forth on MRMC's intra-net.
Resident agrees to, and at all times shall, comply with all laws, rules, and regulations impacting Resident and/or MRMC, and to attend training sessions related to the Anti-Kickback Statute, the Xxxxx Law, and other relevant compliance requirements.
Resident shall participate in training and education sessions relating to the Compliance Program, to include training and education sessions related to 42 U.S.C. § 1320a-7b(b) (the "Anti-Kickback Statute") and 42 U.S.C. § 1395nn (the "Xxxxx Law") as requested by MRMC.
The Parties specifically do not intend to violate the Federal Anti-Fraud and Abuse provisions, which are codified at 42 U.S.C. Section 1320a-7b(b) et seq., the Ethics in Patient Referrals Act, which is codified at 42 U.S.C. Section 1395nn (commonly known as the "Xxxxx Law"), or the South Carolina Provider Self-Referral Act, which is codified at S.C. Code Xxx.
The Parties, by signing this Agreement, hereby certify that they intend to fully comply with the "Employees" Safe Harbor contained at 42 CFR Section 1001.952(i), and the "Bona Fide Employment Relationships" exception to the Xxxxx Law, as set forth in 42 CFR § 411.357(c) and such other applicable laws that may be enacted from time to time.
