Examples of variation date in a sentence
This document has been executed as a deed and takes effect on the Variation Date.
Party B may, notwithstanding the failure to reach an agreement pursuant to Part 5 (28)(b), pay the Accelerated Amount to Party A on the Variation Date and the reduced Fixed Rate to apply from the Relevant Payment Date shall be determined by Party B (or by the Manager on its behalf) in accordance with Part 5 (28)(e) below.
If Part 5 (28)(d)(ii) applies, the reduced Fixed Rate shall be the then applicable Fixed Rate for the Transaction reduced by such amount as, when applied from the Relevant Payment Date through to the Maturity Date for the Transaction, results in reductions of each of the remaining Fixed Amounts payable by Party B under the Transaction, which reductions have an aggregate discounted present value as at the Variation Date equal to the amount of the Accelerated Payment.
Upon such a notice being served, the parties must negotiate in good faith to agree not later than the Business Day immediately preceding the nominated Variation Date, a reduced Fixed Rate which would apply from the Relevant Payment Date in consideration of payment of the Accelerated Amount.
Effective from the Variation Date, the parties agree to each comply with their obligations under the Agreement, as varied by this Variation Deed, in the same way as if those obligations were repeated in full in this Variation Deed, with only those changes necessary for them to apply to this Variation Deed.
