Unsatisfactory Work definition

Unsatisfactory Work means any Construction Work which Administrative Agent and/or the Construction Consultant has reasonably determined has not been completed in a good and workmanlike manner, and, to the extent any Construction Work is not specifically addressed in the construction drawings and specifications, in a manner consistent with sound design principles and/or sound construction practices, or in substantial conformity with the Plans and Specifications, or in accordance with all Applicable Law.
Unsatisfactory Work has the meaning assigned to such term in Section 1.1 of the Building Loan Agreement.
Unsatisfactory Work means any work associated with the Excavation and Street Opening Permit that fails to meet the repair and maintenance requirements for restoring excavations and street openings in the Town’s Right of Ways, protect the general public, or minimize long term maintenance costs as determined by the Town. Such work may include poor workmanship, unsubstantial catch of grass in lawn areas, failed pavement structure such as de-lamination of pavement layers or un-raveling of pavement, settlement of disturbed areas of greater than ½ of an inch as measured along a straight edge of 10 feet in length, or an overall reduction in ride quality after the activity has taken place.

Examples of Unsatisfactory Work in a sentence

  • Borrower will, upon demand of Administrative Agent based upon the advice of the Construction Consultant, correct any Unsatisfactory Work pursuant to Section 7.07; and the advance of any proceeds of any Loan shall not constitute a waiver of Administrative Agent's right to require compliance with this covenant with respect to any such defects or departures from the Plans and Specifications not theretofore discovered by or called to the attention of the Construction Consultant.

  • If the Construction Consultant shall in its reasonable discretion determine that a portion of the Construction Work for which Loans are sought is Unsatisfactory Work, Lender shall be entitled to withhold from such Loans amounts sufficient to pay for correction of the Unsatisfactory Work and Lender shall disburse such amounts to Borrower promptly after such Unsatisfactory Work has been rectified.

  • If the Construction Consultant or Administrative Agent shall reasonably determine that a portion of the Construction Work for which Loans are sought is Unsatisfactory Work, Administrative Agent shall be entitled to withhold from such Loans amounts sufficient to pay for the Unsatisfactory Work and shall advance only the balance of such Loan until such time as Unsatisfactory Work has been corrected to the reasonable satisfaction of the Construction Consultant and Administrative Agent.

  • The Lenders shall, subject to compliance by Borrower with all other applicable requirements of this Agreement, be required to make Loans with respect to such Unsatisfactory Work only after the Construction Consultant and the Administrative Agent shall have determined that the work which had been identified as Unsatisfactory Work has been corrected to the satisfaction of the Construction Consultant and the Administrative Agent.

  • DAY WORK means on item of work requiring the employment of labour with or without materials as the case may be, which, in the opinion of the Senior Engineer /Civil-in-charge, is not capable of being evaluated by the accepted methods of measurement or assessment and is paid for on the basis of the actual labour and materials utilised on the particular item of work referred to.

  • The Work means each and every activity required for the successful performance of the services described in Section II, the Terms of Reference.

  • job work means any treatment or process undertaken by a person on goods belonging to another registered person and the expression “job worker” shall be construed accordingly;

  • Project Work means the work required to complete the Project.

  • New Work means any Services/Deliverables outside the scope of the Contract and not specifically provided under any Statement of Work, that once added will result in the need to provide the Contractor with additional consideration.

  • Make-Ready Work means all work performed or to be performed to prepare AT&T-22STATE’s Conduit Systems, Poles or Anchors and related Facilities for the requested occupancy or attachment of CLEC’s Facilities. Make-Ready Work includes, but is not limited to, clearing obstructions (e.g., by rodding Ducts to ensure clear passage), the rearrangement, transfer, replacement, and removal of existing Facilities on a Pole or in a Conduit System where such work is required solely to accommodate CLEC’s Facilities and not to meet AT&T-22STATE’s business needs or convenience. Make-Ready Work may require “dig ups” of existing Facilities and may include the repair, enlargement or modification of AT&T-22STATE’s Facilities (including, but not limited to, Conduits, Ducts, Handholes and Manholes) or the performance of other work required to make a Pole, Anchor, Conduit or Duct usable for the initial placement of CLEC’s Facilities.

  • Extra Work means any work which is determined by City to be necessary for the proper completion of the Project, but which the Parties did not reasonably anticipate would be necessary at the execution of this Agreement. Consultant shall not perform, nor be compensated for, Extra Work without written authorization from City’s Representative.

  • Project Architect means the architect retained by Lessee to design and supervise construction of the Improvements.

  • Project Improvements means site improvements and facilities that are:

  • Work means all Services to be performed, goods to be delivered, and any appurtenant actions performed, and items produced, conceived, or developed, including Deliverables.

  • Contract Work means everything required to be furnished and done by the Contractor by any one or more of the parts of the Contract referred to in Article 1, except Extra Work as hereinafter defined.

  • a work means the outcome of building or civil engineering works taken as a whole which is sufficient in itself to fulfil an economic or technical function;

  • Permanent Work means the permanent works including equipment to be supplied, executed, erected and maintained in accordance with the Contract.

  • Major Work means any Work to Construct or Maintain the Distribution System that costs more than One Hundred Thousand ($100,000.00) Dollars;

  • Hot Work means work involving electric or gas welding, cutting, brazing, or similar flame or spark-producing operations.

  • Shift Work is defined as the same work performed by two or more employees or two or more successive sets or groups of employees working successive periods.

  • Subprojects means more than one such Subproject.

  • EPC Contractor means Seller’s engineering, procurement and construction contractor or such Person performing those functions.

  • Construction Work means any work in connection with⎯

  • Completion of work means completion of the entire contracted work. Exhaustion of quantity of any particular item mentioned in the bid document shall not imply completion of work or any component thereof.

  • Demonstration project means one of the following projects:

  • Preliminary Work means all work done in the concept and preparatory stages (including non-exhaustively design, artwork, colour matching).

  • Substantial Completion means the stage in the progress of the work as determined and certified by the Contracting Officer in writing to the Contractor, on which the work (or a portion designated by the Government) is sufficiently complete and satisfactory. Substantial completion means that the property may be occupied or used for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which:
