Technology Change definition

Technology Change shall have the meaning specified in Section 26.8 (Technology Changes).
Technology Change means, in respect of a Deal Module: the change in access technology from the Original Technology to the Chosen Technology, or addition of the Chosen Technology, at the Premises; or where a Premises is part of a Multi- Premises Site, reconfiguring the nbn® Network used at the Premises from an NTD deployed in a Centralised Deployment location to an NTD located within that Premises (regardless of whether this involves a change in the Original Technology).
Technology Change means a material change to the technology infrastructure or applications used to provide any Transition Service, which change has a material adverse impact on any Transition Service or on another party's technology infrastructure or applications.

  • Except for any rights expressly granted under this Agreement, the RSP (and any Downstream Customer) does not obtain any right, title or interest (whether legal, equitable or statutory) in any part of the infrastructure, cable and associated equipment installed or used by nbn in connection with the Technology Change under or in accordance with this Agreement.
