  • For Customers with Basic or Standard Level Support Services or for Customers with Premier Level Support Services where such Integration requires eight (8) man hours or more of development work, AvePoint shall make its best, commercially reasonable, efforts to offer such Integration to Customer at an addi- tional fee for the man hours required beyond those covered under the Support Addendum and on the same basis and at the same rates as charged by Ave- Point to other similarly situated customers.

  • Any Licensed Property and Support Services (as de- fined in Section 1 of the Support Addendum) shall be provided to Customer in accordance with AvePoint’s DPIS Policy.

  • Except as may be set forth on the Support Addendum, Subscription Licences Addendum or Software as a Service (SaaS) Addendum attached hereto, AvePoint is under no obligation to provide any services to Customer with respect to the Licensed Property (including, without limitation, any installation of the Software or Licensed Property, training or maintenance), without prejudice to Customer's rights in case of defects according to Sections 5 and 7.

  • Neither Party shall be liable to the other Party for any delay or failure in the performance of its obligations under this Agreement or the Support Addendum while in effect or otherwise if such delay or failure arises from any cause or causes beyond the control of such Party.
