Subject Technology definition

Subject Technology means the Baylor Technology, Improvements, and the MAS Technology.
Subject Technology means all inventions, compounds, know-how, methods, and, materials necessary to make or use DSM PTG Materials which were developed as of the Effective Date and which include but are not limited to all inventions which are covered by any claim of any of the patents identified on Exhibit A hereto together all pending and issued reissues, re-examinations, divisions, continuations, continuations-in-part, renewals, extensions and additions thereto, and all foreign counterparts and applications for foreign counterparts of the foregoing (collectively, the “Patents”).
Subject Technology shall also includes pending U.S. Patent Applications, if any, together with all applications for patent or like protection on said invention and all patents or like protection that may in the future be granted on said invention whether in the United States of America or any other country and all substitutions for and divisions, continuations, continuations in part, renewals, reissues, extensions and the like on said applications and patents.

  • Each Party shall notify the other of any claim, lawsuit or other proceeding related to the Subject Technology.

  • The grant in Paragraph 2.1 shall be subject to, restricted by and nonexclusive with respect to practice of the Subject Technology by the LICENSOR and its Affiliates in the Field for further research and development purposes only, and for all purposes in any field in which LICENSEE does not retain an exclusive license hereunder.


More Definitions of Subject Technology

Subject Technology means the technology, know-how, methods, inventions and confidential information related to LICENSOR's Enhanced Quantum Well Infrared Photodetectors (EQWIPs) which were designed, developed and invented by LICENSOR as of the Effective Date. The term Subject Technology shall include U.S. Patent Number 5,539,206 entitled "Enhanced Quantum Well Infrared Photodetector" by Xxxxxx X. Xxxxxxxx issued July 23, 1996, and all inventions described or claimed therein, together with all patent, or like protection on said inventions that have or may in the future be granted, whether in the United States of America or any other country, and all substitutions for and divisions, continuations, continuations-in-part, renewals, reissues, extensions and the like on said applications and patents. The term Subject Technology shall also include any improvement technology, know-how, methods, inventions, patent applications, patents and maskworks made or obtained by LICENSOR in connection with the EQWIPs, their materials or structure, LICENSOR's ongoing Advanced EQWIP Project and any LICENSOR follow-on Projects thereto, so long as this Agreement is in full force and effect. Subject Technology shall not include any technology, know-how, methods, inventions, patent applications, patents, maskworks or confidential information developed by any division, subsidiary or Affiliate of Lockheed Xxxxxx Corporation other than Xxxxxx Systems.
Subject Technology means (i) U.S. provisional patent application No. 63/154,928 more fully identified in Schedule A, including any United States patents that issue therefrom or any substitutions for or divisionals, continuations, continuations-in-part, renewals, reissues, reexaminations, extensions and the like thereof, together with any foreign counterparts of any of the foregoing (“Licensed Patents”), and (ii) any and all IMPROVEMENTS.
Subject Technology has the meaning prescribed to it under the BCM License.
Subject Technology means (i) the issued patents, and patents arising out of the patent applications, listed on Exhibit A hereto, (ii) all reissues, continuations, continuations-in-part, extensions, reexaminations, and foreign counterparts thereof, (iii) all invention disclosures, trade secrets and know-how owned by Medtronic prior to the date of this Agreement which relate specifically to the Wet Electrode Products and Wet Electrode Generators disclosed in the patents and the patent applications listed on Exhibit A, and (iv) those improvements, enhancements and modifications defined in Section 2.6(c). The Subject Technology does not include any trademarks, trade names or service marks owned or used by Medtronic.
Subject Technology means and include all right, title and interest owned by BAYLOR as of the Agreement Date in any technology, biological materials, methods, documents, materials, tests, know-how and all confidential information existing as of the Agreement Date pertaining to the following technology disclosures (as listed in Appendix A):
Subject Technology means all information pertaining to the manufacture of Licensed Products, including know-how, trade secrets and inventions (whether patentable or not), owned or possessed by a party or its Affiliates at the Effective Date or at any time during the term of this Agreement; provided, however, that "Subject Technology" does not include information described in Schedule 2.
