STEP 5. Any dispute which has not been resolved by the above grievance procedure may be submitted to arbitration by the aggrieved party, providing it is submitted within ten ( 10) working days after the grievance panel meeting. STEP 5. Arbitration If the matter is still not resolved at any of the previous steps, the Union shall notify the Employer of its intent to submit the grievance to arbitration within ten (10) business days of the mediation session. Upon such written notification, the parties shall jointly request a list of eleven (11) arbitrators from either the American Arbitration Association (AAA) or the Public Employment Relations Commission (PERC) and select a single arbitrator to hear the case by alternately striking the names from the list. The right to strike first shall be determined by the flip of a coin. The selection of the arbitrator and scheduling of the hearing shall be done in as timely a manner as possible. The Employer and the Union agree that the decision of the arbitrator shall be final and binding on both parties. Each party shall be responsible for compensating its own witnesses and representatives. The losing party shall pay the arbitrator's fees. All time frames referred to in this grievance procedure may be extended upon mutual agreement of the parties or moved to the next Step.
STEP 5. If the grievance is not satisfactorily resolved between the Chapter 16 representative and the Superintendent, the Association representative will be called upon to 17 meet with the Superintendent in order to resolve the grievance.
