Any Periodic Payments to be made after the death of any Claimant or Successor Payee shall be made to such party as shall have been designated in, or in accordance with, the Settlement Agreement or, if the Settlement Agreement does not provide for such designation, then to the party designated in conformity with this paragraph 8.
The parties have entered into a written Settlement Agreement, whereby they agree to resolve all matters contained in the Notice of Charges with the revocation of Respondent’s certificate and employment eligibility.

The Parties further acknowledge and agree that such confidential mediation communications and Confidential Information have not and will not be used for any purpose other than for evaluating claims for purposes of entering into this Settlement Agreement.
