Serious Default definition

Serious Default means a breach by the Service Provider of its obligations under a Service Agreement which in the reasonable opinion of the Customer materially prejudices the health, safety or welfare of a Service User;
Serious Default means a Default on the part of the Contractor including but not limited to a Default which materially and adversely affects the School or prejudices the health, safety or welfare of any Service User, pupil, employee of member of the School, Staff, visitor or any member of the general public;

Examples of Serious Default in a sentence

  • Where in the view of the Council a complaint relates to a Safeguarding matter, failure to inform the Council in compliance with clause 11.20 will be a Serious Default on the part of the Operator.

  • Either Party may terminate the Agreement immediately and without notice or indemnification on the grounds of a Serious Default by the other Party.

  • You must meet the accreditation criteria for the duration of the contract or otherwise a Serious Default Notice will be served.
