Schedule of Performance definition

Schedule of Performance means that schedule of performance, attached hereto as Exhibit G and incorporated herein, setting forth the timelines for Milestones in the design, development, construction, and completion of the Project (including a construction timeline in customary form) together with the dates for submission of documentation required under this Agreement, which schedule shall be attached to the Development Plan and to the Declaration.

Schedule of Performance means the Schedule of Performance attached hereto as Exhibit C and made a part hereof.

Schedule of Performance means the document attached to this Agreement as Attachment No. 5.

Examples of Schedule of Performance in a sentence

• Within sixty (60) days after the earlier of (i) completion of construction or (ii) the time established for completion of construction in this Schedule of Performance.

• If Escrow is not in condition to close by the time established therefor in the Schedule of Performance, then the party which has fully performed under this Agreement may, in writing, demand the return of money or property and terminate this Agreement.

• Within ninety (90) days after the earlier of (i) the commencement of construction or (ii) the time established in this Schedule of Performance for the commencement of construction of the Improvements.

• The recording of the Recordable Documents hereunder (the “Closing”) is to be accomplished within thirty (30) days of the parties’ satisfaction of all of Conditions Precedent to Closing, but in no event later than the last day established therefor in the Schedule of Performance.

• Within thirty (30) days after the earlier to occur of: (i) the Closing, or (ii) the time established in this Schedule of Performance for the Closing (per item 2, above).

More Definitions of Schedule of Performance

Schedule of Performance means the Schedule of Performance attached hereto as Attachment No. 3 and incorporated herein by reference, setting out the dates and/or time periods by which the First Closing and the Second Closing occurs and by which certain obligations with respect to the development of the Residential Component and the Retail Component must be accomplished. The Schedule of Performance is subject to Section 602 and revision from time to time as mutually agreed upon in writing between the Developer and the Director, and the Director is authorized to make such revisions as he or she deems reasonably necessary.

Schedule of Performance means the document describing the schedule by which construction and development of the Project will occur, attached hereto as Exhibit C and incorporated herein by this reference.

Schedule of Performance means that schedule of performance setting forth the timelines for Milestones in the development, construction, and completion of the Project, including a construction timeline in customary form, and dates for submission of documentation required under this Covenant, attached as Exhibit B hereto.
