A Small Business qualifying under this paragraph (2) will no longer be an LMI Enterprise as of the 180th day after the closing of the SBIC financing unless, on or before such date, at least 50% of its employees or tangible assets are lo- cated in LMI Zones or at least 35% of its full-time employees have primary residences in LMI Zones.
A Small Business that does not meet the requirements of paragraph (1) of this definition as of the time of ap- plication for SBIC financing but that certifies at such time that it intends to meet the requirements within 180 days after the closing of the SBIC financing.
