Sale Property has the meaning set forth in Section 9.06(a).
Sale Property means that portion of the BART Station Property that XXXX was authorized to sell to the Authority pursuant to the terms of Section 5.5 of the Original DDA and the expired Sale Agreement.

Seller agrees to sell to Buyer and Buyer agrees to purchase from Seller the Sale Property all on the terms, covenants and conditions set forth herein. No claim relating to the Sale Property shall be included if such claim is directly or indirectly related to or arising from any matter with respect to which the Seller is required to indemnify Buyer under the terms of this Agreement.
