Sale Property definition

Sale Property has the meaning set forth in Section 9.06(a).
Sale Property means that portion of the BART Station Property that XXXX was authorized to sell to the Authority pursuant to the terms of Section 5.5 of the Original DDA and the expired Sale Agreement.
Sale Property means, with respect to each of the Properties described on Exhibit A-1, the Real Property, the Personal Property and the Intangible Property. Collectively, such Properties shall be referred to as the "Sale Properties."

Sale Property means the real property located at 000 Xxxxxxxx Xx. X. in the City and legally described in Exhibit A attached to this Agreement;

Sale Property means (a) the real property located in unincorporated King County, Washington, commonly known as Renaissance Village Apartments and described on Exhibit A attached hereto (the "Land"), with all improvements thereon and appurtenances thereto (the "Improvements", with the Land and the Improvements being collectively the "Real Property"), and (b) the personal property (collectively, the "Personal Property") consisting of tangible and intangible personal property, including, without limitation, all warranty, guaranty and similar claims relating to the physical condition of the Land, Improvements and Personal Property with respect to damages accruing after Closing, whether accrued or unaccrued, contingent or noncontingent, and all furniture, furnishings, fixtures, equipment, appliances and other personal property located in, on, or about the Real Property, including, without limitation, all personal property listed on Schedule 1 hereto, but excluding all items owned by tenants or other occupants of the Real Property, and (c) all of Seller's interest in all leases or other occupancy agreements relating to any portion of the Sale Property (the "Leases"). Seller agrees to sell to Buyer and Buyer agrees to purchase from Seller the Sale Property all on the terms, covenants and conditions set forth herein. No claim relating to the Sale Property shall be included if such claim is directly or indirectly related to or arising from any matter with respect to which the Seller is required to indemnify Buyer under the terms of this Agreement.
