Requisition of Use definition

Requisition of Use shall have the meaning set forth in the Event of Loss definition contained herein.
Requisition of Use with respect to a Unit shall mean the taking, condemnation, confiscation or seizure of, requisition of title to or use of, such Unit by the act of the United States or any foreign government or any state or local authority within the United States or any instrumentality or agency of any of the foregoing.
Requisition of Use shall have the meaning set forth in the definition of Event of Loss. SEVERABLE MODIFICATION shall mean any Modification to the Leased Property permitted hereunder which can be readily removed therefrom without impairing the current or residual value, utility or remaining useful life of the Leased Property. SUBSIDIARY of any Person shall mean any corporation, partnership, limited liability company, limited liability partnership, joint venture, trust or estate of which (or in which) more than 50% of (a) the Voting Stock of such corporation, (b) the interest in the capital or profits of such partnership, limited liability company, limited liability partnership, or joint venture or (c) the beneficial interest in such trust or estate is at the time directly or indirectly owned or controlled by such Person, by such Person and one or more of its other Subsidiaries or by one or more of such Person's other Subsidiaries.

Examples of Requisition of Use in a sentence

  • In the case of a Requisition of Use not constituting an Event of Loss, this Facility Lease shall continue, and each and every obligation of the Lessee hereunder and under each Transaction Document shall remain in full force and effect.

  • Lessee hereby assumes and shall bear the entire risk of casualty, whether or not insured against, of the equipment from any and every cause whatsoever, and from requisition for use by governmental authority under the power of eminent domain or otherwise (Requisition of Use), from the date of commencement of this Lease.

Requisition of Use means, with respect to a Site, the confiscation, seizure or requisition of use of such Site (or such a substantial portion thereof so as to render operation of such Site by a private party commercially impractical) by the act of any Governmental Authority, but only if such confiscation, seizure or requisition of use continues for a period of more than twelve (12) consecutive months or beyond the Expiration Date for such Site.

Retained Assets shall mean (i) the Lessee's ownership interest in PVNGS other than the Undivided Interest, the related Generation Entitlement Share and the Real Property Interest, (ii) Severable Capital Improvements title to the undivided interest in which is retained by the Lessee in accordance with
