Examples of recognition order in a sentence
As of the Effective Date, except as provided in the Plan, in the Confirmation Order, or, as to matters involving Canadian law, in the Confirmation Recognition Order all Persons shall be precluded from asserting against the Debtors or the Reorganized Debtors, any other or further claims, debts, rights, causes of action, liabilities, or equity interests relating to the Debtors based upon any act, omission, transaction, or other activity of any nature that occurred prior to the Effective Date.
The Canadian Recognition Order shall have been issued; provided, however, that entry of the Canadian Recognition Order shall only be a condition to the Effective Date with regard to those Debtors incorporated, formed or otherwise organized under Canadian law.
The Canadian Bankruptcy Court shall have entered the Canadian Recognition Order, which (i) shall be in form and substance reasonably satisfactory to the Agents, (ii) shall recognize the Confirmation Order entered by the Bankruptcy Court and (iii) shall not have been reversed, modified, amended, vacated or stayed, and, unless otherwise agreed by the Administrative Agent, all appeal periods relating to such order shall have expired and no appeals from such order shall be pending.
Xxxxxxxxx agrees and acknowledges that Sellers, including through its representatives, are and may continue soliciting inquiries, proposals or offers from third parties in connection with any Alternative Transaction pursuant to the terms of the Bidding Procedures Order and the Canadian Bidding Procedures Recognition Order.
From and after the Effective Date, the Claims asserted by the parties prosecuting litigation against the Debtors will be subject to the terms and conditions of the Plan, including (without limitation) the discharge provisions of such plan and the injunction provided in the Plan.On October 20, 2004 the Debtors were granted a Recognition Order under the Companies' Creditors Arrangement Act.
