Proposed Settlement definition

Proposed Settlement means the settlement described in this Agreement, before final approval by the Court.
Proposed Settlement shall have the meaning set forth in Section 16.1(e).
Proposed Settlement means all terms, provisions, and proposals suggested or considered in the negotiations, discussions, communications, and deliberations that culminated in the Settlement Agreement, whether or not incorporated into the Settlement Agreement.

Examples of Proposed Settlement in a sentence

  • To be timely, written notice of an objection in the appropriate form must be mailed, with a postmark date no later than sixty days from the Notice Commencement Date, to Proposed Settlement Class Counsel, Xxxxxxxx X.

  • The right to object to the Proposed Settlement must be exercised individually by an individual Class Member, not as a member of a group and, except in the case of a deceased or incapacitated Class Member, not by another person acting or purporting to act in a representative capacity.

  • The objector or his or her counsel may also file Objections with the Court, with service on Proposed Settlement Class Counsel and TMH’s counsel.

  • Plaintiffs and Proposed Settlement Class Counsel recognize and acknowledge, however, the expense and length of continued proceedings necessary to prosecute the Litigation against TMH through motions practice, trial, and potential appeals.

  • Class Members who do not request exclusion from the Settlement Class may object to the Proposed Settlement.


More Definitions of Proposed Settlement

Proposed Settlement means an agreement regarding a class action that is subject to court approval and that, if approved, would be binding on some or all class members.
