  • It is specifically agreed and understood that given the uncertainty as to the extent of Tenant's damages in the event Potential Landlord fails to timely complete the Proposed Improvements hereunder, such liquidated damages are reasonable and contemplate Tenant’s actual or anticipated harm as a result of such breach, and are not intended to serve as a penalty.

  • Taking for expansion of Okeechobee Boulevard shall not be deemed to be a material taking of the Property unless such taking materially affects the ability of the Purchaser to develop the Proposed Improvements upon the Property, whereupon such taking would be deemed to be a material taking.


More Definitions of Proposed Improvements

Proposed Improvements are the proposed improvements for the Proposed Use which would be constructed upon the Property in accordance with this Agreement.

Proposed Improvements means any new Improvement, which has not yet been constructed, installed or erected, and includes demolition or removal of any building or other structure, and also includes any change of the exterior appearance of a building or other Existing Improvement as defined above.
Proposed Improvements means Purchaser’s proposed improvements to the Land as more particularly described on Exhibit C attached hereto and incorporated herein by this reference.

Related to Proposed Improvements

  • Project Improvements means site improvements and facilities that are:

  • Plans and Specifications means the plans, drawings and specifications reasonably necessary to properly assess and review proposed Work prior to issuance of any approval that may be required under this Agreement;
