Patent Country definition

Patent Country means any country in which at least one unexpired patent application or patent within PATENT RIGHTS is currently pending or issued.
Patent Country means, with respect to a particular Licensed Product, a country in which at the time of the sale of such Licensed Product in such country, the manufacture, use or sale of such Licensed Product would infringe a Valid Claim in such country; and a "Non-Patent Country" shall mean, with respect to such Licensed Product, a country which a the time of sale of such Licensed Product in such country is not a Patent Country.
