Non-Exclusive Products definition

Non-Exclusive Products has the meaning set forth in Section 3.3.

Non-Exclusive Products means Products listed on Schedule A-2 that are manufactured by Alba and packaged in accordance with the Non-Exclusive Product Specifications (hereinafter defined), along with any Improvements thereto.

Non-Exclusive Products means (a) NK Cells and Gamma Delta T Cell Products, and (b) TCR Non-Exclusive Products, in each case as generated or Developed by Ziopharm. For clarity, Non-Exclusive Products include all forms, formulations, presentations, doses, administrations and package configurations thereof.

Examples of Non-Exclusive Products in a sentence

• If any Travelers Insurer is a non-exclusive provider of a Product to any International Parent Distributor in any Covered Country on the date of this Agreement (the "Non-Exclusive Products"), such Travelers Insurer shall have the right to be a provider of such Product, on a non-exclusive, Level Playing Field basis, to such International Parent Distributor in such country during the Term.

• ELITE hereby grants to EPIC a non-exclusive license (“Non-Exclusive License” or “Non-Exclusive Licensing Rights”) without the right to further sublicense, to manufacture, market and sell the Non-Exclusive Products as listed in Schedule D in the United States, including the right to reference the ANDA Number, where appropriate, for approval to market the Non-Exclusive Products in the United States.

• ELITE shall be the only other company allowed to manufacture, market and sell the Non-Exclusive Products and ELITE shall only sell to clinics.

• EPIC shall not share in any profits from Non-Exclusive Products sold by ELITE.

• If any Travelers Insurer is a non-exclusive provider of a Product to any Domestic Parent Distributor on the date of this Agreement (the "Non-Exclusive Products"), such Travelers Insurer shall have the right to be a provider of such Product, on a non-exclusive, Level Playing Field basis, to such Domestic Parent Distributor during the Term.

Non-Exclusive Products means (i) products and services of and/or for biopsy needles, including aspiration, cutting needles and breast localization needles (“Non-Exclusive Products Category 1”); (ii) products and services of and/or for interventional guidewires for use in all applications (“Non-Exclusive Products Category 2); (iii) products and services of and/or for interventional vascular catheters (< 6 hours), including for PTCA, predilation, etc. (“Non-Exclusive Products Category 3”); (iv) products and services of and/or for indwelling vascular catheters (> 6 hours), including for CVCC, PICC, etc. (“Non-Exclusive Products Category 4”); (v) products and services of and/or for pacemakers, including leads (“Non-Exclusive Products Category 5”); (vi) products and services of and/or for implantable cardiac defibrillators and related devices, including their leads (“Non-Exclusive Products Category 6”); (vii) products and services of and/or for auditory implants, e.g., cochlear implants (“Non-Exclusive Products Category 7”); and (viii) products and services of and/or for applications for neuro stimulation, including for deep brain stimulation (“Non-Exclusive Products Category 8”), as depicted in the chart at Exhibit C.

Non-Exclusive Products means and shall be restricted to casino chips and pairs of casino dice which incorporate the LL Technology when used for gambling purposes;

Non-Exclusive Products means those products in the Non-Exclusive Categories (i) manufactured and distributed pursuant to this Agreement, (ii) approved and authorized by MSLO pursuant to this Agreement, and (iii) bearing one or more of the Trademarks on the product itself or on a hang-tag label and/or other means of packaging.

Non-Exclusive Products means and shall be restricted to products derived from Rub & Reveal applications which incorporate NOCOPI Technology; provided, however, LICENSEE shall not use NOCOPI Technology to market, sell, manufacture or have manufactured cash register tapes or any other products derived from Rub & Reveal applications that NOCOPI can demonstrate through documentary proof it was selling as of the Effective Date (collectively, the "EXCLUDED PRODUCTS").

Non-Exclusive Products means the Bridge Solution.
