Mortgage Asset definition

Mortgage Asset means the Related Security (together with the benefit of the underlying Mortgage Loan).
Mortgage Asset means a Whole Loan, a Junior Interest, a Mezzanine Loan, a Bridge Loan, a Preferred Equity Interest, an Equity Asset or, as applicable, a Condominium Loan or Land Loan, in each case, the Underlying Mortgaged Property for which is included in the categories for Property Types of Mortgage Assets; provided, however, the portion of any Mortgage Asset to be pledged to the Administrative Agent shall not include any Retained Interest (if any).
Mortgage Asset means Indebtedness owed to the Company or a Subsidiary of the Company and secured by a mortgage or deed of trust on a fee interest or a leasehold interest in Real Property and all collateral security related thereto.

Examples of Mortgage Asset in a sentence

  • If no successor is so appointed and approved by the end of such thirty (30) day period, the Custodian shall deliver all Mortgage Asset Files to the Lender at the address set forth in Section 17 hereto unless otherwise instructed by a Designated Officer of Lender.

  • In the event of any such removal, the Custodian shall promptly transfer to the successor custodian or to the Lender, as directed in writing by a Designated Officer of the Lender, all affected Mortgage Asset Files.

  • Upon termination of this Agreement, the related Mortgage Asset Files will be released by the Custodian in accordance with the Lender’s written instructions.


More Definitions of Mortgage Asset

Mortgage Asset means (A) a domestic residential mortgage loan, Construction Loan or Cooperative Loan (i) that has a Mortgage File, and (ii) that is a first or more junior lien on residential property evidenced by a Mortgage Note, which is secured by a Mortgage, (B) a domestic Land Financing that has a Mortgage File or (C) any other asset as agreed upon by the Sellers, the Custodian and the Financing Party.
Mortgage Asset means the Related Security (together with the benefit of the underlying Mortgage Loan) and "Mortgage Assets" shall be construed accordingly.
Mortgage Asset. Any Whole Loan, Junior Interest, Mezzanine Loan, Preferred Equity, CMBS, RMBS, Non-Controlling Interest, Pass-Through Interest, Distressed Debt, REO Property Loan or Transitional Asset (i) the Underlying Mortgaged Property for which is included in the categories for Types of Mortgaged Property, and (ii) which the Seller has delivered to the Agent, on behalf of the Buyers, or its designee (including the Custodian) in connection with any Transaction hereunder. In no event shall “Mortgage Asset” include any equity class issued by a CDO or CLO vehicle.
