Indecent liberties definition

Indecent liberties means the same as that term is defined in Section 76-5-401.1.
Indecent liberties means knowingly causing sexual contact with a person by forcible compulsion or when the person is incapable of consent by reason of mental defect, mental incapacitation, or phys- ical helplessness. Sexual contact is defined as any nonconsensual touching of the sexual or other intimate parts of a person done for the purpose of gratifying the sexual desire of either party.
Indecent liberties means conduct that is as serious as touching the anus, buttocks, or genitals of a person, or the breast of a female. In deciding whether conduct amounts to indecent liberties, use your judgment and common sense. You may consider factors such as:
