Producer agrees to review the Department of Health and Human Services (“HHS”) Office of Inspector General List of Excluded Individuals and Entities and the General Services Administration System for Awards Management (collectively, “Exclusion Lists”) to ensure that no persons or entities employed by or utilized by Producer or by any of Producer’s Downstream Entities are included on such Exclusion Lists.
Producer agrees to review the Exclusion Lists prior to initially hiring, appointing or contracting with any new employee, temporary employee or Downstream Entity and at least once per month thereafter to confirm that such persons and entities are not included on such Exclusion Lists.

More Definitions of Exclusion Lists

Exclusion Lists means the US DHHS’s OIG’s List of Excluded Individuals/Entities (located at https://oig.hhs.gov/exclusions/index.asp) and the General Services Administration’s List of Parties Excluded from Federal Programs (located at https://www.sam.gov/SAM/).

Exclusion Lists means the then-current: (i) HHS/OIG List of Excluded Individuals/Entities (available through the Internet at xxxx://xxx.xxx.xxx.xxx); (ii) General Services Administration’s List of Parties Excluded from Federal Programs (available through the Internet at xxxx://xxx.xxxx.xxx); and (iii) FDA Debarment List (available through the Internet at xxxx://xxx.xxx.xxx/ora/compliance_ref/debar/). “Ineligible Person” shall mean a person who: (x) is currently excluded, debarred, suspended, or otherwise ineligible to participate in the Federal Health Care Program (as defined in 42 U.S.C. § 1320a (7b(f)) or in Federal procurement or non-procurement programs, including, without limitation, Section 306 (a) or 306 (b) of the Federal Food, Drug and Cosmetic Act (codified at 21 U.S.C. 335(a) and 335(b)), the Generic Drug Enforcement Act of 1992 (21 U.S.C. § 301 et. seq.) as amended from time to time, or 21 C.F.R. § 312.70, as amended from time to time; (y) has been convicted of a criminal offense that falls within the ambit of 42 U.S.C. § 1320a-7(a), but has not yet been excluded, debarred, suspended, or otherwise declared ineligible; or (z) is listed on an Exclusion List. The Consultant shall promptly notify the Company, in writing, if the Consultant becomes listed on any of the sites identified in this Section 4.C. during the term and for three (3) years after its termination.
