Evaluation Software definition

Evaluation Software means Software that is specified in an Order as provided under an evaluation license or a free trial license.
Evaluation Software means Software licensed for internal evaluation purposes and not for productive business use.
Evaluation Software means the software developed by RFM pursuant to this Agreement to evaluate the functionality of Products relative to the Specifications, in object code only.

  • If there is no period identified, such use is limited to 30 days after the Evaluation Software and Services are made available to You.

More Definitions of Evaluation Software

Evaluation Software means Phoenix’s software products, and related documentation provided to Licensee, as requested here. Phoenix grants to Licensee, and Licensee accepts, subject to the terms of this Agreement, a temporary, limited, royalty-free, non- transferable, non-exclusive right to use the Evaluation Software for testing and evaluation/non-production purposes only (“License”) and related product documentation at no charge subject to the terms and restrictions set forth in this Software Evaluation Agreement (“Agreement”). You are not permitted to use the Evaluation Software in any manner not expressly authorized by this License. You acknowledge and agree that ownership of the Evaluation Software and all subsequent copies thereof regardless of the form or media are held by Phoenix. Licensee may not use the Evaluation Software at any location other than the Designated Installation Site, except that such use may be transferred temporarily to a backup computer system if the Designated Installation Site is inoperable due to malfunction, preventative maintenance, or engineering changes. Phoenix has no obligation to provide additional versions of Evaluation Software or to make any changes or improvements to Evaluation Software. Phoenix has no obligation to provide maintenance or support for Evaluation Software. Licensee’s License for Evaluation Software is limited to 30 days commencing on the first day Licensee has access to the Evaluation Software; provided, however, either Phoenix or Licensee, by written notice to other may earlier terminate the Length of Evaluation Period at any time for any reason or no reason. Phoenix may, at its option, extend the period in writing. Licensee grants Phoenix a royalty-free, worldwide, perpetual license to use and incorporate into Phoenix products, any suggestion, idea, enhancement, feedback, recommendation or other information Licensee provides relating to Evaluation Software.
Evaluation Software means Software made available by Pivotal directly to USG for a limited period of time at no charge to enable USG to evaluate such Software prior to making a final decision on licensing or purchasing such from Pivotal.
Evaluation Software means any software (in object code form or source code form) and/or hardware materials provided by or on behalf of Immersion Ireland to Samsung during or prior to the Term that are either: (1) indicated by or on behalf of Immersion Ireland at or after time of delivery that such software/hardware materials are for internal evaluation (or is, in the case of software, identified as an alpha or beta version), is otherwise software/hardware not indicated in writing at or after delivery as an “official release” of such software/hardware; (2) software/hardware that, under all of the circumstances, could reasonably be considered by Immersion Ireland to be software/hardware intended solely for internal evaluation by Samsung; or (3) any other software that is not Licensed Software pursuant to the terms and conditions of this Agreement. For the avoidance of doubt, Licensed Software shall not include any Evaluation Software.”
Evaluation Software means a computer software program used to determine and evaluate the financial consequences of a finance leasing transaction; "Example Cashflow Report" means the Cashflow Report set out in Annex B hereto comprising a Cashflow Report and Tax Report produced by the Initial Evaluation Software, on the basis of the Initial Notional Accounts and the Principles and the Assumptions as at the date hereof and the Initial Notional Accounts; "FA 1997" means the Finance Xxx 0000; "Final Accounting Period" means the Accounting Period in which the earlier of the Lease Period End Date and the Termination Payment Date occurs PROVIDED THAT where any Assumption or Termination Assumption (as the case may be) shall have proved incorrect the Lessor may by notice to PPC at any time (whether or not the "Final Accounting Period" would otherwise have expired) determine the "Final Accounting Period" to be the earliest Accounting Period of the Lessor required to enable the Revised Cashflow Report or Revised Termination Cashflow Report to be prepared in accordance with the provisions of this Financial Schedule on the basis of the "Final Date" thereby determined (and taking the Assumptions or Termination Assumptions, as corrected, into account); "Final Date" means the final date upon which Corporation Tax may be paid in respect of profits of the Lessor arising in the Accounting Period after the Final Accounting Period of the Lessor without the Lessor incurring interest or penalties but so that if more than one such payment of Corporation Tax becomes due the latest date upon which such payment may be paid without incurring interest and penalties shall be the Final Date;

For the avoidance of doubt, Immersion TouchSense Software shall not include any Evaluation Software.
Evaluation Software. If the Software has been identified by XR Solutions Inc. as “Evaluation” Software, then the provisions of this section apply and shall supersede any other conflicting term of this Agreement. Evaluation Software means any Arrcus Software provided to Licensee for evaluation purposes or otherwise designated by Arrcus as evaluation software.
