Employee grievance definition

Employee grievance is defined as a complaint by one (1) or more unit members that the District has violated provisions of this Agreement, provided the conduct complained of directly affects the unit member(s).
Employee grievance means a grievance, complaint or other claim asserted by any employee at any time following the Ratification Date in respect of the application of the IBT MOU terms to the specific circumstances of such employee, which grievance, complaint or claim does not, individually or in the aggregate with any similar claims by other employees, either (i) challenge the legality, validity or enforceability generally of the IBT MOU or the framework set forth therein or (ii) assert a claim for monetary damages in excess of a customary compensation adjustment.
Employee grievance as used in this Agreement is a written claim involving the interpretation, application or claim of breach or violation of a specific provision of this Agreement which an employee has not been able to adjust with his or her supervisor, and which at the time such written claim is filed, denies to such employee a right given to such employee under such specific provision of this Agreement.
