Derivative Materials definition

Derivative Materials means materials derived or created by or on behalf of Participant or its Personnel in accordance with the terms of this Agreement, and any Approved Data Licence, which are based on, or created or derived from, Data Products separately from, and independently of, the Data Republic Platform, but do not include the underlying Data Products themselves.
Derivative Materials means materials, data and insights derived or created by or on behalf of Devicedesk in accordance with clause 10.2, which are based on, or created or derived from, the Data.
Derivative Materials means the Licensed Materials Derivative Materials and Reprogrammed iPS Cell Derivative Materials, collectively.

More Definitions of Derivative Materials

Derivative Materials means any and all derivative materials (within the meaning of Section 101 of the U.S. Copyright Act of 1978, as amended) based on any Course Materials or other copyrightable works of Juniper, whether created by Juniper or JNCAAM.

Derivative Materials means any other materials or products, other than the Material and Banked Material that are derived from, are produced by the use of, or that wholly or partially incorporate the Material or Banked Material.
Derivative Materials means materials, data and insights derived or created by or on behalf of Geora in accordance with clause 12.2, which are based on, or created or derived from, the Data. Force Majeure Event affecting a party means a circumstance beyond the reasonable control of that party causing that party to be unable to observe or perform on time an obligation under this Agreement, including acts of God, lightning strikes, earthquakes, floods, storms, explosions, fires and any natural disaster, acts of public enemies, terrorism, riots, civil commotion, malicious damage, sabotage, revolution and acts of war and war, general strikes (other than of its own staff), embargo, or power, water and other utility shortage. Geora Account has the meaning given to that term in clause 3(a)).
Derivative Materials means Materials that are created out of or by using or incorporating the Information. Intellectual Property Rights means any and all design rights, trademarks (whether registered or not), patents, inventions (whether patentable or not), patentable material, registered designs, trade secrets, copyrights (whether registered or not) including trade data, settlement prices, data files and any part of the data thereof, moral rights, rights in databases, utility models, and all other intellectual property rights, whether registrable or not, including those subsisting (in any part of the world) in inventions, designs, drawings, performances, computer programs, know-how, improvements, business or brand names, domain names, database rights, metatags, goodwill or the style of presentation of goods or services, including applications for the protection of any such rights and all other intellectual property rights of any kind that may be available in any jurisdiction, whether arising under legislation, common law or otherwise. Losses means all losses, liabilities, judgments, suits, actions, proceedings, claims, penalties, injuries, delays, damages, costs and expenses (including legal and other professional fees and disbursements). Materials means any data, information and material in whatsoever form (including specifications, plans, methodologies, software, databases, reports, processes, designs, documentation, information and know-how).
