Defective Services definition

Defective Services means Services of an inferior quality or which are otherwise inconsistent with this Contract.

Defective Services means services or the results of any services which are not in conformity with the supply contract, are of inferior quality or workmanship or are otherwise unsatisfactory;

Defective Services means Services not properly performed in accordance with the Agreement and/or applicable Service Levels.

Examples of Defective Services in a sentence

• Without limiting Clause11, any cost or expense incurred by the Principal in connection with the Defective Goods and/or the Defective Services under this Clause 23, shall be a debt due from the Contractor to the Principal.

• Where the Contractor has made good any Defective Goods or Defective Service under this Clause 23, those Goods and/or Services will be subject to the same Defects Liability Period as the original Goods and/or Services, from the date the Contractor made good the Defective Goods or Defective Services (as applicable).

• Without limiting Clause 11, any cost or expense incurred by the Principal in connection with the Defective Goods and/or the Defective Services under this Clause 23, shall be a debt due from the Contractor to the Principal.

• Where the Contractor has made good any Defective Goods or Defective Service under this Clause23, those Goods and/or Services will be subject to the same Defects Liability Period as the original Goods and/or Services, from the date the Contractor made good the Defective Goods or Defective Services (as applicable).

• In the event that the Company identifies any of the Services as being defective, deficient or otherwise failing to meet the requirements and standards set out in this Agreement (“Defective Services”), the Company may within [24] months of the completion of the Services instruct the Contractor to correct or re-perform such Defective Services.

Defective Services means Services supplied to NSW RFS that do not conform to the Specifications or a Purchase Order, Interim Approval Reference or a Dispatch, breach the warranties in clause 7.1, Part C, or are damaged or otherwise defective. Dispatch means an order for an operational task placed in accordance with clause 4.2, Part C which sets out the details of the Tasks to be performed by the Supplier and incorporates the terms of this Deed. Dispatch Number is a number that is issued to identify a Dispatch. Dispute Procedure means the procedure described in clause 14, Part C. ELT means emergency locator transponder. Emergency for the purpose of this Deed means an Incident where:

Defective Services means any Services that fail to conform to the Contract Documents or otherwise prove to be defective or deficient. Delay Liquidated Damages is defined in a Supplement if Delay Liquidated Damages are applicable to the scope of Services covered by such Supplement. Dispute is defined in Section 10.1.

Defective Services means Services provided to customers prior to Completion which are defective. For the purposes of this definition, “defective” means in respect of claims or complaints raised by customers, a failure to meet the terms and conditions as to quality and specification under which the Services were sold to such customers;
