Amazon Site definition

Amazon Site means, as applicable, the CA Amazon Site, the MX Amazon Site, or the US Amazon Site.

Amazon Site means the website, the primary home page of which is identified by the url xxx.xxxxxx.xx, and any successor or replacement of such website.

Amazon Site means xxxxx://xxxxxxxx.xxxxxx.xxx/events and xxxxx://xxxxxxx-xxxxxxx- xxxxxx.xxxxxxxxxx.xxx (and any successor or related site designated by us), as may be updated from time to time.

• We may refuse registration in FBA of any product in connection with the Amazon Site, including on the basis that it is an FBA Excluded Product or that it violates applicable Program Policies.

• If the address we have for you in connection with the Amazon Site is outdated, incorrect or outside India or if we cannot make arrangements for you to pay for the return shipment, the Unit(s) will be deemed abandoned and we may elect to dispose of or destroy the Unit(s) as appropriate based on the inventory and, subject to any replacement or reimbursement done as required under applicable law, this Agreement and our Program Policies, retain any proceeds we may receive from the disposal.

• Any Sellable Units registered in connection with the Amazon Site that are also Amazon Fulfilment Units and that are properly returned will be placed back into the inventory of Your Products in the FBA Program for the Amazon Site.

• It is your responsibility as a seller on the Amazon Site to choose the most applicable product tax codes and assign Harmonized System of Nomenclature / Service accounting Code applicable for your listing, such that the correct tax rate is applied on all listings offered for sale by you.

• You may not include any product in the FBA program which is a FBA Excluded Product for the Amazon Site you wish to register Your Product with.

Amazon Site means, as applicable, the CA Amazon Site, the JP Amazon Site, the MX Amazon Site, or the US Amazon Site. "Amazon Transaction Information" means, collectively, Order Information and any other data or information acquired by you or your Affiliates from Amazon, its Affiliates, or otherwise as a result of this Agreement, the transactions contemplated by this Agreement, or the parties' performance under this Agreement.

Amazon Site means, as applicable, the website the primary home page of which is identified by the urlURL xxx.xxxxxx.xxx.xx, and any successor or replacement of such website. "Amazon Transaction Information" means, collectively, Order Information and any other data or information acquired by you or your Affiliates from Amazon, its Affiliates, or otherwise as a result of this Agreement, the transactions contemplated by this Agreement, or the parties' performance under this Agreement.

Amazon Site means that web site, the primary home page of which is identified by the URL www.amazon.com (and any successor or replacement web site) and also includes any other web sites maintained by or for CustomFlix or its Affiliates (including those web sites the respective home pages of which are identified by the URLs www.A9.com, www.amazon.co.uk. www.amazon.fr. www amazon co.ip. www.amazon.ca. www.amazon.de. www.IMDb.com. and www.customflix.coro).

Amazon Site means the website xxx.xxxxxx.xxx and the mobile version thereof (app and browser), or any successor URL designated by Amazon for customers in the Territory. Amazon Site does not include any other URL maintained by or on behalf of Amazon or its Affiliates. For the avoidance of doubt and without limiting the generality of the foregoing, Amazon Site does not include (A) any existing or future Affiliate websites principally serving geographic regions outside of the Territory (e.g., xxx.xxxxxx.xx), (B) any existing or future affiliated websites principally serving the Territory but operating under a separate url (e.g., xxx.xxxxxx.xxx), or (C) any existing or future websites owned by Amazon or its Affiliates and hosted on xxx.xxxxxx.xxx but designated with a distinct third level domain name (e.g., xxx.xxx.xxxxxx.xxx); provided that (i) Amazon may not create or use a distinct third level domain name website for the purpose of offering a Short-Term Installments Product or a Long-Term Installments Product to consumers who have an account on Xxxxxx.xxx to circumvent Section 8.1 of this Agreement and (ii) in the event Amazon launches and makes available to consumer customers in the Territory a new distinct third level domain name website for the sale of general merchandise goods, and the annual sales by such third level domain name website are in excess of [***] as defined and disclosed in Amazon’s public filings of the same period, such third level domain name website will be included in the definition of Amazon Site for the purposes of Section 8.1 of the Agreement.

Amazon Site means the xxxxxx.xxx site, the xxxxxxx.xxx site, the xxxxxxxxxxxx.xxx site, or the xxxxxxx.xxx site, as applicable. “Your site” means any site(s) and any software application(s) that you link to the Amazon Site. BY CHECKING THE BOX INDICATING THAT YOU AGREE TO THE TERMS AND CONDITIONS OF THIS OPERATING AGREEMENT, OR BY CONTINUING TO PARTICIPATE IN THE PROGRAM FOLLOWING OUR POSTING OF A CHANGE NOTICE, REVISED OPERATING AGREEMENT, OR REVISED OPERATIONAL DOCUMENTATION ON THE XXXXXX.XXX SITE, YOU (A) AGREE TO BE BOUND BY THIS OPERATING AGREEMENT; (B) ACKNOWLEDGE AND AGREE THAT YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS EXPRESSLY SET FORTH IN THIS OPERATING AGREEMENT; AND (C) HEREBY REPRESENT AND WARRANT THAT YOU ARE LAWFULLY ABLE TO ENTER INTO CONTRACTS (E.G., YOU ARE NOT A MINOR) AND THAT YOU ARE AND WILL REMAIN IN COMPLIANCE WITH THIS OPERATING AGREEMENT, INCLUDING THEASSOCIATES PROGRAM PARTICIPATION REQUIREMENTS. IN ADDITION, IF THIS OPERATING AGREEMENT IS BEING AGREED TO BY A COMPANY OR OTHER LEGAL ENTITY, THEN THE PERSON AGREEING TO THIS OPERATING AGREEMENT ON BEHALF OF THAT COMPANY OR ENTITY HEREBY REPRESENTS AND WARRANTS THAT HE OR SHE IS AUTHORIZED AND LAWFULLY ABLE TO BIND THAT COMPANY OR ENTITY TO THIS OPERATING AGREEMENT.

Amazon Site means the TR Amazon Site.

Amazon Site has the meaning ascribed to it in the Commercial Agreement.
