TIMELY PERFORMANCE. (a) SELLER's timely performance is a critical element of this Contract.
TIMELY PERFORMANCE. Time is of the essence as to the performance of the obligations required of the respective parties under this Agreement.
TIMELY PERFORMANCE. Participant acknowledges that expeditious completion of work and delivery of related deliverables set forth under this Agreement and the attached SOW are of the utmost importance to MassTech.
TIMELY PERFORMANCE. The requirements of this Agreement shall be carried out in a timely manner according to a schedule negotiated by and satisfactory to the Parties.
TIMELY PERFORMANCE. Owner shall perform the duties set forth in this Article 12 in a reasonably expeditious fashion and in accordance with the project schedule so as to permit the orderly and timely progress of Design/Builder’s Design Services and of the Work.
TIMELY PERFORMANCE. If Supplier has knowledge that anything prevents or threatens to prevent the timely performance of the Work under this Agreement, Supplier shall immediately notify Company's Representative thereof and include all relevant information concerning the delay or potential delay.

TIMELY PERFORMANCE. Contractor acknowledges that expeditious completion of Contractor’s services and the expeditious delivery of the deliverables is of the utmost importance to the MSBA and that Contractor will diligently and continuously perform its Services during the term of this Agreement.
TIMELY PERFORMANCE. (a) Seller’s timely performance is a critical element of this Subcontract.
TIMELY PERFORMANCE. Time is of the essence in the performance of this Contract and failure to perform on time, if unexcused, shall be considered a material breach of this Contract. Seller shall immediately provide written notice to the Company of all pertinent details regarding any actual or potential cause or event that threatens the timely performance of the Contract. In the event of any actual or potential delay, Seller shall promptly notify the Buyer of the actions being taken to overcome or minimize the delay, provide the Buyer with a written recovery schedule, and unless Seller is excused from timely performance as provided in the Force Majeure or Excusable Delay clause of this Contract, ship via air or other expedited routing, without additional cost to the Company, to avoid or minimize delay to the maximum extent possible. Unless advance shipment has been authorized in advance in writing by Company’s Buyer, Company shall refuse or return, at Seller’s risk and expense, shipments made prior to thirty (30) days before the required scheduled delivery dates, and Company shall not be liable for any payment to Seller on such advance deliveries until the scheduled delivery dates in accordance with Section 18, Payment, below.
